The Punjab Separation of Judicial and Executive Functions Act, 1964, is a procedural statute designed to implement the constitutional mandate of separating the judiciary from the executive branch. Before this Act, administrative officers often exercised judicial powers, leading to conflicts of interest. This legislation amends the Code of Criminal Procedure, 1898, to create two distinct classes of magistrates: Judicial Magistrates, who handle trials and sentencing under the supervision of the High Court, and Executive Magistrates, who manage law and order and preventive measures under the State Government. For the ordinary citizen, this ensures that their criminal trials are conducted by independent, legally trained judges rather than administrative officials.
