The Punjab Laws (Extension No. 7) Act, 1960
1. Short tide and commcnccment.
(1) This Acl may be called (he Punjab Laws (Extension NO. 7) Act, 1960. (2) It shall come into force at once.
2. Definitions-
Tn this Act,- (a) "Schedule" means a Schedule appended to this Act ; (h) "transferred tenitories" means the tcni tories which, immediarel y before thc ,l SL November, 1956, wcl'e comp~ised in the State of Paliala and East Punjab States Union.
3. Interprclnlion.
Thc Pulljab General Clauses Act, 1898, shall apply for the inrerpretation of Ihis Act as it applies for the interpretation of a Punjab Act.
4. Extension of cerfain laws 10 rans sf erred tcrrirories.
(1) All the enacrments, as amended from rime to time, speciried in Schedule I and so much of any of chc cnacrrnents, as amended from lime to limet specified in Schedule I1 as extends to the ttrrirol.ics which. immcdialely hefo~me thc 1st Noilembcr, 1056. were colnpt-isud in rIlc Starc of Pul?i;th and rclillcs lo ma~ters with respects io whilc rllc Sralc Legislature has power to make laws for a Srate, and 311 i.ules, reg~~lillions, r~otifications, orders and by-laivs madc, and alt directions or instructions issued, thcreundcr, which are in force i~nrnediately before thc commencement of this ACL in the said terri~ories, are hereby extendcd to, and shall be in force in, the transferred territories.
5. Consuuc~ion of cenain rzfcrcnces
In the enactments, or rules, regulations. notifications, ordcrs and by-laws made, and directions or inslruclions issued. thereunder, as referred to in seclion 4, any refelhence- (1) to a law which i s not in Porce in rhe transferred teri-iitories .shall in relation to such ter~.irorics, be construed as a refercnce to the corresponding law, if any, in force in such territories : and (2) to the State of Punjab, by whatever form of words, shall be construed as iicluding as reference to lhe transferred terri torics.
6. Rcpcals and savings.
If immcdiatcly before the commencement of this Act, there is in Force ln the lransfc'crrcd territories any law corrcsponding to any of rhc enactments or rblcs, rcgularions, notificarions, orders and by-laws made, and directions or instructions issued, thereunder,, extended to those lerritories by sccrion 4, that law, including the enactments specified in Schcdule 111, shall on rhc commencement of this Act, save as orhenvise expressly provjdcd in this Acr, stand repealed: Provided that such repeal shall not affect- (a) the previous operation of any law so repealed or anything duly done or suffered thereunder ; or (b) any right, privilege, obligation or liability acquircd or incurred under any law so repealed ; or (c) any penally, fol-feilure or punishmenr 'incurred in rcspecr- of any offence comrni ired against any law s o repealed : or (d) any in~festig:~tion, legal proceedirl~ or rcn~cdy in rzspect of any such right, privilege, obligation. liability, penalty, forfeiture or punishrnenr as aforesaid ; and any such investigation, legal proceeding or remedy may be instituted, co n ti nued or enforced, and - any such penalty, forfei lure or punishment may be imposed, as if this Act had not been passed :. Provided further [hat anything done or any action raken under any laws so repealed shall bc deemed to have been donc or taken under the correspunding provisions of the enactment extended by section 4 to rhe transferred ierritories, and s hall continue lo be in force accordingIy , unlcss and until superseded by any thing done or any action taken undcr !he enactment so ex tendcd.
7. Powers of Courrs and other authorities for purposes o f facilitaling application OF the enaclments speciiied in Schedule I or 11 or rules, eLc.
For purposes of facilitating the application in the transferred territories of any enactments specified in Schedule I or Schedule II or of any rule, regualtion, notification, order, by-law, direcrion or instruction referred to in section 4, any court or other authority may construe the same with such alterations, not affecting the substance, as may be necessary or proper to adapt it to the matter before the court or other authority.
8. Power ro make rules etc, no1 to be affecled.
Nothing contained in this Act shall affect the power of the State Government or of any officer or authority, exercisable under the enactments specified in Schedules I and II to add to, amend, vary or rescind the rules, regulations, notifications, orders and by-laws made, and directions or instructions issued, as extended by section 4 to the transferred territories.
9. Power to removc dirficulues
If any difficulty arises in giving effect in the transferred territories to the provisions of any enactment specified in Schedule I or Schedule II, the State Government may, by order notified in the Official Gazette, make such provisions or give such directions as appear to it to be necessary or expedient for the removal of the difficulty.
