The Odisha Gift Goods (Unlawful Possession) Act, 1964
1. Short title, extent and commencement.
(1) This Act may bc callcd the Orissa Gift Goods (unlawful possession) Act, 1964. (2) -It shall extend to the whoIe cf thc State of Orissa. (3) It shall come into rorcc at oncc.
2. Definitions
In this Acl: un lcss thc context otl~erwise requires - (a) 'gift goods' weans ally of the following goods, n nnlely: - (ii) 111itk powdcr; (iii) vegetable oil ; supplied by way of gift, by ally sciicf organi- satjon to any Stale Ciovernrrcrlt OF to the Central Govcrnn~ent or to any other person on behalf of such Gowr nmenl; (b) 'relicf orgauisatjou' means any ol'ganisa- tion spccificd in tlle Scl~cd~rle appeildcd to this Act.
3. Unlawful possession of gift goods to be an offence.
Whocver without reasonable cause is in posses- sion of or dcaIs with, any gift goods o thenvise than in conformity with the schcme relating to the suppIy, distribution and custody of such goods shall on con- viction, bc IiabIe to be punished with imprisonment: for R term, which mny extend to two years or with fine or wit11 both. ~~~plnl~afiot~-Ignoram of thc identity of the moods being gift goods shaIl not by itself be deemed yo be 'reasonable cause' for the purposes of this sec- tion.
4. Offences to be cognizable and triable by Magistrates.
All offences punishable under section 3 shall be cognizable and no court inferior to that of a Magistrate of the First Class shall try any such offence.
5. Power to amend the Schedule.
The State Government may, by notification, add any organisation to, or omit any organisation from the Schedule; and on the publication of such notificatioa, such orzanisation shall be deemed to be included in, or as the case may be, omitted from the Schedule.
6. Notifications to be laid before the Legislature.
Ever;l noiification issued under this Act shall comeinto force-witheffectfrom tlzedate on ivhiclz it is publlslled and shaI1, as soon as possible, after it is published, be laid bcfore the Legislative Assembly for a totaI period of fourteen days which may be comprised in onc or more sessions and shall be sub- ject to such modifications as the AssernbIy may makc dnring the said period.
