The Odisha Aided Educational Institutions (Appointment of Teachers Second Validation) Act, 1978

(1) This Act may be called the Orissa Aided Educational Institutions ( Appointment of Teachers and Second Validation ) Act, 1978. (2) It shall extend to the whole of the Stntc of Orissa.

Tn this Act, unless the context otherwi~erequires,- (a) "Education Act'' rneans the Orissa Education Act, 1969 ; (b) "managiag authority" means the managingcommitteeor governing body, as the case may be, of an aided educational iastitutio~ ; (c) words and expressions used in this Act, but not deEncd hcrcin, shall have the Sara meaning as assigned to then1 respectively under tbe Education Act or under the Rules and Regulations framed thereunder. $1) words and expressions used in this Act but ~iot dehed herein, shaIl have thc samc meaning as assigned fo them res~;ectively under the Edvcation Act or under the Rules and Regulations framed tllereu nder.

Notwithstanding any thing contai ne.f in the Education Act or in the Rules and Regulations fram~d thereunder, the appointment of icachcrs belonging to any of the cate~ories specified in the Schedule, of aided educational institutions being schools, filade by .the mana~ing authorities of such schools during -t.h period between the 1 st April, 1975 and the 1st December, 1.976 i ~ t h the approval whether -prio~ cr sul~scqucnt t o t11e appointment of the concerned Circle Wspector of Schools in the case of High 'Schools and of 't he ,concerned Grcl c Tnspec- tor of Schools or District lInspector of Schools in the case of Middle English Scools, shall, for all intents and purposes, be,tteefiled 'to have b c p 'validly made and no , such apfro'i'ntmcnt shall be liable to be cl~allengcd ur q~csti~ned,'~dforc any autl~ority or in any ,couTt ,of law m r d y on .the grmnd that the appointment -wasTnade :othcrbwise -than 'in accordance with tfle procedure prescribed by -the !Education .Act .and the Rumles .and 3Rc&ulatinns framed fhercuhder : Provided $hat mtb* !in :this*scct.ioh shall stpply to any teacher so appointed if :he had completed fie age of fifty-eight Years b~ the date of ,his,appointment; Provided further that in the case of tcachers appo- during thc .aFaxsaid ,period .against any {leave vacancy or any vacancy caused on account of deputa- tion of any teacher for training ,or against a post created 'for a specific period, 'tlic provisions of this section shall apply only to the perioa of leave or deputation o'r the specific period, as the .case may be.

1. Teachers who by the date of their appointment possessed the qualifications prescribed under the Education Act or under the regulations made by the Board of Secondary Education constituted under the Orissa Secondary Education Act, 1953, as the case may be.

2. Teachers who were relieved prior to the 1st April, 1975 for undergoing training and have joined during the period between the 1st April, 1975 and the 1st December, 1976 after successful completion of training.

3. Teachers who were releived during the said period for undergoing training and have joined after successful completion of training.

4. Teachers who are not trained but have acquired sufficient experience in teaching provided they get themselves trained within such period as the State Government may fix in that behalf.
