Validation.

(1) Notwithstanding anything contained in the Odisha Staff Selection Commission Rules, 1993, relating to conduct of examination for recruitment of Staff Nurses by the Commission for the period beginning with the 13th December, 1993 to the 27th July, 1998, the selection of Staff Nurses made during the said period shall be deemed to have been made validly and accordingly, the appointment of three hundred twenty-six Staff Nurses, whose names, date of birth and dates of appointment on adhoc basis, have been mentioned in the Schedule below, who are continuing in the service, shall be deemed to have been validly and regularly made as such with effect from the date of the commencement of this Act and, no such appointment shall be challenged in any court of law merely on the ground that such appointments were made otherwise than in accordance with the provisions of the Odisha Staff Selection Commission Rules, 1993 prevailing at the time of appointment of such Staff Nurses on adhoc basis. (2) The Staff Nurses whose appointments on adhoc basis are so validated under sub-section (1) shall be enblock junior to those who have been appointed to the post of Staff Nurses in accordance with the recruitment procedure existing prior to the period mentioned in sub-section (1). (3) The inter-se-seniority of Staff Nurses mentioned in the Schedule whose appointments are so validated shall be fixed on the basis of their dates of appointment on adhoc basis as Staff Nurses. (4) The services, rendered by these Staff Nurses including those Staff Nurses who have, while continuing as such, died or retired, as the case may be, prior to the commencement of this Act shall count for the purpose of pension, leave, increment and promotion.
