Penalities
The Odisha Debt Relief Act, 1980(1) If any person wilfully contravenes any provision of this Act or of any rule made thereunder, or fails to comply with any lawful order made thereunder or contravenes any such order, he shall be punishable with imprisonment of either description which may extend to two years or with fine which may extend to two thousand rupees or with both. (2) The State Government may confer, on an Executive Magistrate, the powers of a Judicial Magistrate of the first class or of the second class for trial of offences under sub-section (1), and on such conferment of the powers, the Executive Magistrate, on whom the powers are so conferred, shall be deemed, for the purposes of the Code of Criminal Procedure, 1973, to be a Judicial Magistrate of the first class or of the second class, as the case may be : Provided that no Magistrate shall take cognizance of any offence except with the previous sanction of the Collector of the district. (3) An offence under this Act may be tried summarily by a Magistrate.
