Power to investigation
The Nagaland (Sale of Petroleum & Petroleum Products, including Motors Spirit & Lubricant Taxation) Act, 1967(1) Every officer appointed under section 5 not below the rank of Inspector or any officer specially empowered by the Commissioner shall within the area for which he is appointed, have power to investigate all offences punishable under this Act. (2) Every such officer shall, in the conduct of such investigation, exercise the powers conferred b the Code of Criminal Procedure, 1898 upon Officer-in-Charge of Police Station for the investigation of cognizable offence; Provided that if such officer is of the opinion that there is not sufficient evidence or reasonable ground of suspicion to justify the forwarding of an accused to a Magistrate, or that person arrested may be discharged with a warning, such officer shall release him on his executing a bond, with or without sureties, to appear if and when so required before a Magistrate and shall make a full report of the case to the Commissioner and shall be guided by the order which he will receive on such report.
