0. Preamble
The Nagaland Legislative Assembly Members Salaries, allowances, Pensions (Amendment) Act, 2001.

Received the assent of the Governor of Nagaland on 26/09/2001 and published in the Nagaland Gazette Extraordinary dated: 18IhofOctober, 2001.
Further to amend the Nagaland Legislative Assembly Member's Salaries Allowances andPension Act 1964.
Whereas it is expedient to amend the Nagaland Assembly Members Salaries, Allowances and Pension Act 1964 (Nagaland Act No. of 1964) in the manner hereunder appending.
It is hereby enacted in the fifty second year of the Republic of India as follows:
1. SHORT TITLEAND COMMENCEMENT.
- (i) This Act shall be called Nagaland Legislative Assembly Member's Salaries,Allowances and Pension (Amendment)Act 2001.
- (ii) It shall come into force on such a date as the State government may by Notification in Official Gazette appoint.
2. AMENDMENT OFSECTION3A.
Second proviso to Sub Section (I) of Section3A of the Principal Act shall be deleted and after Sub Section 5 the following shall be inserted as Sub Sections 6 and 7.
6. (a) There shall be paid a family person at the rate of fifty percent of the pension in a manner provided hereunder and as may be further prescribed in this behalf.
- (i) If a deceased ex-member orpensioner leaves behind a window or a widower, the family pension shall become payable to the widow or widower, failing which to the eligible child.
- (ii) If sons and unmarried daughters are alive, unmarried daughters shall not be eligible for family pension, unless the sons attain the age of twenty five years and thereby become ineligible for the grant of family pension.
- (iii) Where family pension is granted under this rule to a minor, it shall be payable to the guardian onbehalf of the minor.
- (b) Notwithstanding what is provided in clause (a) above, no member of the family who is a government servant shallbe paid a family pension. 7. (a) When a sitting member is killed by a terrorist act, the next of kin may be granted an ex-gratia payment of Rs 5lakhaonly.
- (b) When a member expires while still serving his term, the next of kin may be granted an ex-gratiapaymentofRs 2lakhsonly.
