Amendment of section 20

In section 20 of the Manipur Land Revenue & Land Reforms Act, 1960 –

(i) Under sub-section (1), the following proviso shall be inserted, namely, - "Provided that if any person holding land is granted permission to divert such land or part of it by the competent authority, such person shall pay fees to the State Government at the rate of twenty-five rupees per square metre in case of diversion of agricultural land for residential purposes and one hundred rupees per square metre in case of diversion of agricultural land for non-residential purposes.";

(ii) in sub-section (4), for the words "penalty not exceeding one thousand rupees", the words "penalty not less than two hundred and fifty rupees per square metre in case of diversion of agricultural land for residential purposes, and one thousand rupees per square metre in case of diversion of agricultural land for non-residential purposes" shall be substituted;

(iii) in sub-section (5), for the words "penalty not exceeding one thousand rupees for such contravention, and a further penalty not exceeding four rupees for each day", the words "penalty not less than two hundred and fifty rupees per square metre in case of diversion of agricultural land for residential purposes and one thousand rupees per square metre in case of diversion of agricultural land for non-residential purposes one thousand rupees per square metre for such contravention, and a further penalty not less than five hundred rupees for each day" shall be substituted;

(iv) after sub-section (5), the following new sub-section (6) shall be inserted, namely,-

"(6) Notwithstanding the provisions contained in the Manipur Land Revenue and Land Reforms Act, 1960, an unauthorised diversion of land that has taken place before the commencement of Manipur Land Revenue & Land Reforms (Amendment) Act, 2014 shall be afforded an opportunity to be regularized in respect of built up or constructed area only of the diverted land, on payment of fine of one thousand rupees and fee at the rate of twenty-five rupees per square metre in case of diversion of agricultural land for residential purposes and one hundred rupees per square metre in case of diversion of agricultural land for non-residential purposes:

Provided, further, that an application to this effect is made by the owner of the land to the competent authority within three months from the commencement of the Manipur Land Revenue & Land Reforms(Amendment) Act, 2014 and the competent authority shall grant such permission with prior approval of the State Government:

Provided, further, that diversion in respect of the remaining portion of land not covered by built up or construction area shall be liable to penalty and fees at the rate as applicable under the provisions of the Manipur Land Revenue & Land Reforms (Amendment) Act,2014."
