The Manipur State Commission for Other Backward Classes (Amendment) Act, 2006
1. Short title and commencement
1. Short title and commencement.- (1) This Act may be called the Manipur Commission for Other Backward Classes (Amendment) Act, 2006.
(2) It shall be deemed to have come into force with effect from the date on which the Manipur State Commission for Other Backward Classes Act, 2006 came into force.
2. Amendment of section 1
2. Amendment of section 1.- For sub-section (3) of section 1 of the Manipur Commission for Other Backward Classes Act, 2006 (hereinafter referred to as the principal Act), the following shall be substituted, namely,-
"(3) It shall come into force immediately."
3. Amendment of section 2
3. Amendment of section 2.- For clause (d) of section 2 of the principal Act, the following shall be substituted, namely,-
'(d) “lists” means lists prepared by the Government from time to time for the purposes of making provision for reservation of seats in educational institutions and for reservation of appointments or posts in favour of other backward classes of citizens which, in the opinion of the Government, are not adequately represented in the services under the Government as well as any other authority under the control of or funded wholly or partly by the Government.”.
4. Amendment of section 3
4. Amendment of section 3.- In section 3 of the principal Act --
(i) in sub-section (1), for the word “may”, the word “shall” shall be substituted; (ii) in sub-section (2),- (a) for the word “shall”, the word “may” shall be substituted; (b) after clause (a), the following clause (aa) shall be inserted, namely,- “(aa) a Social Scientist;”.
5. Amendment of section 4
5. Amendment of section 4.- In sub-section (1) of section 4 of the principal Act, for the words “one year”, the words “three years” shall be substituted.
6. Amendment of section 9
6. Amendment of section 9.- In section 9 of the principal Act -
(i) in sub-section (1), for the words “any such other”, the words “any other” shall be substituted and at the end the following sentence “The advice so tendered by the Commission shall ordinarily be binding upon the Government.” shall be inserted; (ii) in sub-section (2), for the words “control of State Government or”, the words “control of or” shall be substituted; (iii) in sub-section (4), the words “at the request of the Government” shall be deleted.
7. Amendment of section 10
7. Amendment of section 10. - In section 10 of the principal Act -
(i) in clause (a), the words “from any part of State” shall be deleted; (ii) for clause (c), the following shall be substituted, namely,- “(c) receiving evidence on affidavits;”.
8. Amendment of section 19
8. Amendment of section 19.- In sub-section (1) of section 19 of the principal Act, in between the words “notification” and “issued”, the words and figures “No.F.1/Comm/MOBC/2005 dated 6-2-2006 and No.1/Comm(MOBC)/05(Pt-I) dated 6-2-2006” shall be inserted.
