Bare Act
The Presidency Small Cause Courts (Bombay Amendment) Act, 1933
This Act is a legislative amendment to the Presidency Small Cause Courts Act, 1882, specifically designed to regulate judicial procedure within the Bombay jurisdiction. Its primary purpose is to decongest higher courts by discouraging litigants from filing minor civil disputes in the High Court or the Bombay City Civil Court when they could be resolved in the Small Cause Court. It achieves this by modifying cost-recovery rules, increasing the monetary threshold for jurisdiction, and integrating the Bombay City Civil Court into existing procedural frameworks. For the ordinary citizen, this means that filing a low-value lawsuit in a higher court may result in the loss of the right to claim legal costs or the imposition of financial penalties, thereby incentivizing the use of the appropriate, lower-tier court.
