The Police (Incitement to Disaffection) (Maharashtra Amendment) Act, 1983
1. Short title and commencement
(1) This Act may be called the Police (Incitement to Disaffection) (Maharashtra Amendment) Act, 1983. (2) It shall come into force at once.
2. Amendment of section 3 of Act XXII of 1922
In section 3 of the Police (Incitement to Disaffection) Act, 1922 (hereinafter referred to as the principal Act), for the words "punishable with imprisonment which may extend to six months, or with fine not extending to two hundred rupees, or with both" the words "punishable with imprisonment which may extend to three years, or with fine which may extend to five thousand rupees, or with both" shall be substituted.
3. Amendment of section 4 of Act XXII of 1922
In section 4 of the principal Act, for sub-section (2), the following shall be substituted, namely:— "(2) Notwithstanding anything contained in the Code of Criminal Procedure, 1973, an offence punishable under this Act shall be cognisable and non-bailable."
