Repeals and Savings

The following enactments are hereby repealed, namely :—

1. (a) The Hyderabad Land Improvement Loans Act, 1950;
2. (b) The Land Improvement Loans Act, 1883, as modified and applied to the Saurashtra area of the State of Bombay by the State of Saurashtra (Application of Central and Bombay Acts) Ordinance, 1948;
3. (c) Section 9A of the Land Improvement Loans Act, 1883, in its application to the Vidarbha region of the State of Bombay;
4. (d) The Central Provinces and Berar Land Improvement Loans (Amendment) Act, 1949;
5. (e) The Hyderabad Agriculturists' Loans Act, 1950;
6. (f) The Agriculturists' Loans Act, 1884, as modified and applied to the Saurashtra area of the State of Bombay by the State of Saurashtra (Application of Central and Bombay Acts) Ordinance, 1948;
7. (g) Sections 5A and 7 of the Agriculturists' Loans Act, 1884, in their application to the Vidarbha region of the State of Bombay;
8. (h) The Central Provinces and Berar Agriculturists' Loans (Amendment) Act, 1947;
   • (i) The Central Provinces and Berar Agriculturists' Loans (Amendment) Act, 1949: Provided that—

1. (1) notwithstanding such repeal—
   • (i) an application made for a loan under any of the enactments so repealed shall be deemed to have been made under the provisions of the Land Improvement Loans Act, 1883, or as the case may be, the Agriculturists' Loans Act, 1884, and accordingly such application shall be disposed of;
   • (ii) Any sums due in respect of a loan granted under any of the enactments so repealed (including interest thereon and the costs incurred in making or recovering such sums) shall be recoverable as if this Act had not been passed; and
2. (2) such repeal shall not affect any penalty incurred for misapplication of a loan under any of the enactments so repealed and any such penalty may be imposed as if this Act had not been passed.
