The Indian Ports (Maharashtra Amendment) Act, 1962
1. Short title and commencement.
(1) This Act may be called the Indian Ports (Maharashtra Amendment) Act, 1962. (2) It shall come into force in the Ratnagiri port and the Vijaydurg port on such date as the State Government may, by notification in the Official Gazette, appoint; and in relation to any other port to which the Indian Ports Act, 1908, applies or may hereafter apply, it shall come into force on such date as the State Government may, by like notification, appoint.
2. Amendment of section 35 of Act XV of 1908.
In section 35 of the Indian Ports Act, 1908, in its application to the State of Maharashtra (hereinafter referred to as "the principal Act"), in sub-section (2), for the words "a majority of the pilots", the words "such number of pilots as the State Government may, from time to time, determine in this behalf" shall be substituted.
3. Amendment of section 36 of Act XV of 1908.
In section 36 of the principal Act, to sub-section (1), the following proviso shall be added, namely:— "Provided that, in the case of any port, the State Government may, from time to time, by notification in the Official Gazette, direct that the provisions of this sub-section shall, during such period as may be specified in the notification, not apply, or shall apply subject to such modifications as may be specified therein."
4. Repeal of Maharashtra Ordinance No. IV of 1962.
The Indian Ports (Maharashtra Amendment) Ordinance, 1962, is hereby repealed.
