The Bombay Nursing Homes Registration (Amendment) Act, 2005

(1) This Act may be called the Bombay Nursing Homes Registration (Amendment) Act, 2005. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

In section 2 of the Bombay Nursing Homes Registration Act, 1949 (hereinafter referred to as "the principal Act"), in clause (4), for the words "a maternity home," the words "a maternity home, a physiotherapy establishment, a clinic, a diagnostic centre or such other institution," shall be substituted.

In section 3 of the principal Act, for the words "two months" the words "one month" shall be substituted.

In section 4 of the principal Act, to sub-section (1), the following proviso shall be added, namely:— "Provided that, the local supervising authority shall grant the registration, or as the case may be, refuse it, within a period of three months from the date of receipt of the application, failing which the registration shall be deemed to have been granted."

In section 5 of the principal Act, in sub-section (1),— (a) for the words "a period of one year" the words "a period of three years" shall be substituted; (b) the following proviso shall be added, namely:— "Provided that, such registration may be renewed for a period of three years at a time."

In section 6 of the principal Act, in sub-section (1), for the words "any person" the words "any person, or where the person is a company or an association or body of individuals, any partner, director or manager thereof," shall be substituted.

In section 7 of the principal Act, in sub-section (1), for the words "any person" the words "any person, or where the person is a company or an association or body of individuals, any partner, director or manager thereof," shall be substituted.

In section 16 of the principal Act, in sub-section (2), in clause (b), for the words "registration and renewal thereof" the words "registration and renewal thereof, the form of application for such registration and renewal, and the time limit for disposal of such application" shall be substituted.
