The Bombay Extension of Laws to Non-Scheduled (Partially Excluded) Areas Act, 1954
1. Short title and commencement
(1) This Act may be called the Bombay Extension of Laws to Non-Scheduled (Partially Excluded) Areas Act, 1954. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
2. Definitions
In this Act, unless the context otherwise requires,— (a) 'appointing day' means the date appointed under sub-section (2) of section 1; (b) 'non-scheduled areas' means the areas which were, immediately before the commencement of the Constitution, known as 'partially excluded areas' and which were not declared to be scheduled areas by the Scheduled Areas (Part A States) Scheduled Order, 1950;
3. Extension and amendment of certain laws
The enactments specified in the Schedule shall be extended to, and shall be in force in, the non-scheduled areas and shall be amended in the manner and to the extent specified in the said Schedule.
4. Savings
Nothing in this Act shall affect any order, rule, bye-law, regulation or appointment made or anything done or any action taken or any proceedings pending under any law in force in the non-scheduled areas immediately before the appointed day, but all such orders, rules, bye-laws, regulations, appointments, things done, actions taken and proceedings shall, so far as they are not inconsistent with the provisions of the enactments extended by this Act, be deemed to have been made, done, taken or pending under the corresponding provisions of the said enactments as extended to the said areas and shall continue in force accordingly.
5. Power to remove difficulties
If any difficulty arises in giving effect to the provisions of this Act or of the enactments extended by this Act, the State Government may, by order, do anything which appears to it to be necessary or expedient for the purpose of removing the difficulty: Provided that no such order shall be made after the expiry of two years from the appointed day.
