The Bombay Adjudication Proceedings (Transfer and Continuance) Act, 1947
1. Short title and extent
(1) This Act may be called the Bombay Adjudication Proceedings (Transfer and Continuance) Act, 1947. (2) It extends to the whole of the Province of Bombay.
2. Definitions
In this Act, unless there is anything repugnant in the subject or context,— (a) "Adjudicator" means an Adjudicator appointed under the Bombay Industrial Disputes Act, 1938; (b) "Industrial Tribunal" means an Industrial Tribunal constituted under the Industrial Disputes Act, 1947; (c) "Proceeding" includes any matter which is the subject of an adjudication under the Bombay Industrial Disputes Act, 1938.
3. Transfer of proceedings
Notwithstanding anything contained in the Industrial Disputes Act, 1947, Government may, by notification in the Official Gazette, direct that any proceeding pending before an Adjudicator shall be transferred to an Industrial Tribunal for disposal.
4. Continuance of proceedings
Where any proceeding is transferred to an Industrial Tribunal under section 3, the Industrial Tribunal shall, subject to any special directions in the notification, continue the proceeding from the stage which it had reached at the time of transfer.
5. Saving
Any award made by an Industrial Tribunal in a proceeding transferred to it under section 3 shall be deemed to be an award made under the Industrial Disputes Act, 1947, and shall be enforceable as such.
