Statutory text
- (1) The State Government may, by notification in the Official Gazette, and subject to the condition of previous publication, make rules to carry out the purposes of this Act.
- (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely :—
- (a) the form and manner of making an application for a licence, the fees for such licence and renewal thereof, the period for which, the conditions subject to which and the form in which a licence may be granted, under section 5 ;
- (b) the other grounds, the contravention of which by the licensee, shall entail suspension or cancellation of the licence under section 8 ;
- (c) the fees payable in respect of a duplicate licence under section 10 ;
- (d) the form and manner in which, the period within which and the authority to which, an appeal may be made under section 11, and the procedure to be followed by the appellate authority in disposing of the appeal ;
- (e) any other matter which is to be or may be prescribed.
- (3) Any rule made under this section may provide that a contravention thereof shall be punishable under section 14.
- (4) Every rule made under this section shall be laid, as soon as may be, after it is made, before each House of the State Legislature while it is in session for a total period of thirty days which may be comprised in one session or in two successive sessions, and if, before the expiry of the session in which it is so laid or, the session immediately following, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall, from the date of publication of a notification in the Official Gazette of such decision have effect only in such modified form or be of no effect, as the case may be ; so however that any such modification or annulment shall be without prejudice to the validity of any thing previously done or omitted to be done under that rule. AMENDMENT_1. Short title This Act may be called the Maharashtra Fruit Nurseries and Sale of Fruit Plants (Regulation) (Amendment) Act, 2026. AMENDMENT_2. Amendment of section 14 of Mah. XLV of In section 14 of the Maharashtra Fruit Nurseries and Sale of Fruit Plants (Regulation) Act, 1969,—
- (1) for the portion beginning with the words “he shall, on conviction,” and ending with the words “five thousand rupees or both”, the following portion shall be substituted, namely:— “he shall, on conviction,—
- (i) for the first offence, be punishable with fine which may extend to fifteen thousand rupees;
- (ii) for the second or subsequent offence, be punishable with imprisonment for a term which may extend to six months or with fine which may extend to twenty-five thousand rupees or with both;”;
- (2) in the marginal note, for the word “Penalties.”, the word “Offences.” shall be substituted.”.
