Bare Act
The Maharashtra Civil Courts (Enhancement of Pecuniary Jurisdiction and Amendment) Act, 1977
This Act amends the criminal and pecuniary jurisdiction limits of small cause courts in Maharashtra by raising monetary value thresholds where these courts can exercise their authority. It progressively increases case-limit amounts across various civil procedure sections, allowing courts to handle larger value disputes without them reaching higher district courts. The law applies to all civil matters involving property claims, contracts, and other monetary disputes that fall under the jurisdiction of the Presidency Small Cause Courts and Provincial Small Cause Courts Acts. Importantly, it protects transitional matters by specifying that pending cases filed before the Act took effect will continue under the old monetary limits.
