The Madhya Pradesh Village Refuse (Conversion into Manure) Act, Samvat 2008
1. Short title, extent and commencement
(1) This Act may be called "The Madhya Pradesh Village Refuse (Conversion into Manure) Act, Samvat 2008". (2) It extends to the whole of the Madhya Pradesh, except the merged territories. (3) It shall come into force in such area or areas and on such date or dates as the State Government may, by notification, appoint in this behalf.
2. Definitions
In this Act, unless there is anything repugnant in the subject or context,- (i) "Refuse" means offensive matter, rubbish and dust and includes sweepings of private premises and public streets and slaughter-house refuse but does not include night-soil; (ii) "Village" means any local area which is a village for the purposes of the Madhya Pradesh Land Revenue Code, 1954 (II of 1955) or any other corresponding law for the time being in force in any region of the State.
3. Power to apply Act to any area
The State Government may, by notification, direct that this Act shall apply to any area as may be specified in the notification.
4. Power to regulate sanitation of villages
The State Government or such officer as may be authorised by it in this behalf, may by general or special order direct that within such village or villages as may be specified in the order, all refuse shall, after such date as may be notified, be deposited by the inhabitants in such pits and in such manner as may be prescribed.
5. Power to require villagers to deposit refuse in pits
The State Government or such officer as may be authorised by it in this behalf may, by notice in writing, require an inhabitant of a village, to which an order under section 4 applies, to deposit the refuse generated by him or his household in such pit as may be provided for the purpose.
6. Power to require villagers to fill pits
The State Government or such officer as may be authorised by it in this behalf may, by notice in writing, require any person or a group of persons using any pit for the deposit of manure, to fill such pit in such manner and within such time as may be prescribed.
7. Power to sell manure
The Gram Panchayat or the Janapada Sabha, as the case may be, shall have power to sell the manure converted from the refuse collected in the pits and use the sale proceeds for the purposes of the Act.
8. Power of entry and inspection
Any officer or servant of the Gram Panchayat or the Janapada Sabha, as the case may be, authorised by it in this behalf, may enter and inspect any place where refuse is collected or manure is prepared for the purpose of ensuring that the provisions of this Act or any rules made thereunder are being complied with.
9. Penalty
Any person who contravenes any of the provisions of this Act or any rules made thereunder shall, on conviction by a Magistrate, be punished with a fine which may extend to fifty rupees.
10. Delegation of powers
The State Government may, by notification, delegate all or any of its powers under this Act to any officer or authority subordinate to it.
