The Madhya Pradesh Sale of Khaddar Act, 1953
1. Short title, extent and commencement
(1) This Act may be cited as the Madhya Pradesh Sale of Khaddar Act, 1953. (2) It extends to the whole of Madhya Pradesh. (3) It shall come into force at once.
2. Definitions
In this Act, unless there is anything repugnant in the subject or context,- (a) "Khaddar" means any cloth woven on handloom in India from cotton, silk or woollen yarn handspun in India; (b) "Licence" means a licence granted under the provisions of this Act.
3. Prohibition of sale of Khaddar without a licence
No person shall sell or have in his possession for the purpose of sale any Khaddar except under and in accordance with the conditions of a licence granted in this behalf by the prescribed authority.
4. Power to grant licences
The State Government or such officer as may be authorised by it in this behalf may grant a licence to any person who deals in Khaddar upon such conditions as may be prescribed.
5. Penalty for sale of Khaddar in contravention of the Act
Any person who sells or keeps for sale any cloth as Khaddar in contravention of the provisions of this Act or of any rules made thereunder or of any condition of a licence granted to him shall be punishable with imprisonment which may extend to six months or with fine which may extend to five hundred rupees or with both.
6. Cognizance of offences
No court shall take cognizance of any offence punishable under this Act except upon a report in writing of the facts constituting such offence made by a person who is a public servant as defined in section 21 of the Indian Penal Code, 1860 (XLV of 1860).
7. Power to make rules
(1) The State Government may make rules for the purpose of carrying into effect the provisions of this Act. (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for the form of license to be granted and the fees to be charged for such license and the conditions subject to which it may be granted.
