The Madhya Pradesh Refugees Registration and Movement Act, 1947
1. Short title, extent and commencement
(1) This Act may be called the Madhya Pradesh Refugees Registration and Movement Act, 1947. (2) It extends to the whole of Madhya Pradesh. (3) It shall come into force on such date as the Provincial Government may, by notification, appoint in this behalf.
2. Definitions
In this Act, unless there is anything repugnant in the subject or context,— (a) "Refugee" means any person who, having been ordinarily resident in any place outside India, has, on account of civil disturbances or the fear of such disturbances in any such area, displaced therefrom, come to any place in Madhya Pradesh; (b) "Registration Centre" means a centre notified by the Provincial Government for the registration of refugees; (c) "District Magistrate" includes an Additional District Magistrate.
3. Registration of refugees
(1) Every refugee who has arrived in Madhya Pradesh before the commencement of this Act and has not been registered under any existing rules or orders, or who arrives in Madhya Pradesh on or after such commencement, shall, within seven days of the commencement of this Act or the date of his arrival, as the case may be, present himself at the nearest Registration Centre and furnish such particulars as may be required for his registration. (2) The officer in charge of the Registration Centre shall, on the arrival of a refugee, register him and grant him a certificate of registration in the prescribed form.
4. Movement of refugees
(1) The Provincial Government or any officer authorized by it in this behalf may, by order in writing, direct a refugee to move to such place or area as may be specified in the order and to reside there for such period as may be prescribed. (2) A refugee directed under sub-section (1) to move to any place or area shall not, during the period he is required to reside therein, leave that place or area without the written permission of the District Magistrate or such other officer as may be authorized in this behalf.
5. Penalty for disobedience
Any refugee, who acts in contravention of the provisions of section 3 or fails to comply with any order issued under section 4, shall be punishable with imprisonment which may extend to six months or with fine which may extend to five hundred rupees or with both.
6. Power to arrest
Any police officer not below the rank of a Sub-Inspector may arrest without warrant any person who is reasonably suspected of having committed an offence under this Act.
7. Cognizance of offences
No Court shall take cognizance of any offence punishable under this Act except on a report in writing of the facts constituting such offence made by a police officer not below the rank of a Sub-Inspector or by any officer authorized by the Provincial Government in this behalf.
8. Power to make rules
(1) The Provincial Government may make rules for carrying out the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for— (a) the form of the certificate of registration; (b) the particulars to be furnished by the refugees; (c) the authority by whom and the process by which orders under section 4 may be issued; (d) any other matter which is to be or may be prescribed.
