The Madhya Pradesh Recognized Examinations Act, 1937
1. Short title and extent
(1) This Act may be called the Madhya Pradesh Recognized Examinations Act, 1937. (2) It extends to the whole of Madhya Pradesh.
2. Definitions
In this Act, unless there is anything repugnant in the subject or context,— (a) "recognized examination" means an examination specified in the Schedule to this Act or added to the Schedule under section 8; (b) "unfair means" in relation to an examination means and includes the taking or giving of help in any form and by any means from or to an examinee or other person or body of persons by an examinee during the course of an examination and the retention of any paper, book or notes in the examination hall or inside the premises of the examination centre or the possession of any material related to the subject of examination or the answer sheet or part thereof.
3. Penalty for leakage of question paper
Whoever before, during or after the examination is found guilty of leakage of question paper or renders assistance in leakage of question paper shall be punishable with imprisonment for a term which may extend to three years and with fine which may extend to five thousand rupees.
4. Penalty for using unfair means at examination
Whoever uses, or attempts to use, or aids or abets the use of unfair means at a recognized examination shall be punished with imprisonment which may extend to three years, or with fine, or with both.
5. Penalty for interfering with candidates
Whoever falsely personates any other person, or abets or attempts to abet such personation, for the purpose of taking over the examination on behalf of such person, or interferes with, or attempts to interfere with, the candidates appearing at a recognized examination, shall be punished with imprisonment which may extend to three years, or with fine, or with both.
6. Penalty for damaging property
Whoever willfully damages, or attempts to damage, any property used for, or in connection with, a recognized examination shall be punished with imprisonment which may extend to three years, or with fine, or with both.
7. Penalty for other acts
Whoever does any act which results in the leakage of question paper or affects the secrecy of the recognized examination or causes any other unfair practice shall be punishable with imprisonment for a term which may extend to three years and with fine which may extend to five thousand rupees.
8. Cognizance of offences
No court shall take cognizance of any offence punishable under this Act except upon a report in writing of the facts constituting such offence made by an officer of the examining body or any person authorized by the State Government in this behalf.
