The Madhya Pradesh Nirashriton evam Nirdhan Vyaktiyon ki Sahayta Adhinium 1970

(1) This Act may be called the Madhya Pradesh Nirashriton Evam Nirdhan Vyaktiyon Ki Sahayta Adhiniyam, 1970. (2) It extends to the whole of Madhya Pradesh. (3) It shall come into force on such date as the State Government may, by notification, appoint.

In this Act, unless the context otherwise requires,— (a) "Destitute" means a person who, on account of old age, physical or mental infirmity, is unable to earn his livelihood and has no source of income or means of support and has no near relative to support him; (b) "Poor person" means a person whose annual income does not exceed the limit prescribed by the State Government; (c) "State Government" means the Government of Madhya Pradesh.

The text defines terms like "Family", "Near Relative" and provides for the identification process of beneficiaries in alignment with the Madhya Pradesh Nirashriton Evam Nirdhan Vyaktiyon Ki Sahayta (Sanshodhan) Adhiniyam, 1976 and 1977.

(1) The State Government shall provide for the assistance of destitute and poor persons under the rules prescribed. (2) The quantum of assistance shall be subject to the conditions and limitations specified in the rules. (3) (Clause 2-a) Provision for the application process and the determination of eligibility criteria by the authorized officer. (4) Determination of the subsistence allowance, which shall not exceed Rs. 20,000 per annum, and the manner of payment.

The State Government may make rules for carrying out the purposes of this Act, including the procedure for granting assistance, the designation of officers for implementation, and the review of cases of destitute persons.

The State Government may, by notification, make rules for the implementation of the provisions of this Act.

Nothing in this Act shall affect the provisions of any other law for the time being in force for the protection or assistance of destitute persons.

The provisions of any previous Acts inconsistent with this Act stand repealed.

Any amount paid under this Act, if found to be obtained under false pretenses or misutilized, shall be recoverable as arrears of land revenue.

(1) Repeals the specific sections of the Madhya Pradesh Nirashriton Evam Nirdhan Vyaktiyon Ki Sahayta Adhiniyam, 1956. (2) Repeals the relevant sections of the Act of 1961. (3) Repeals the relevant sections of the Act of 1962.

Provisions for the transition of pending applications and institutional support under the Act of 1969 are to be dealt with under the rules framed under this Act.
