2. Definitions
(1) In these rules, unless the context otherwise requires,— (a) "Act" means the Special Marriage Act, 1954 (43 of 1954); (b) "Marriage" means all marriages solemnized or contracted between persons of any religion or caste without regard to the religion or caste of the parties and includes marriages solemnized under any law, custom, usage or tradition and includes remarriage; (c) "Marriage Registrar" means any Marriage Officer appointed under Section 3 of the Act and Rule 5 of these rules; (d) "Section" means a section of the Act. (2) Words and expressions used in these rules but not defined herein shall have the same meaning as assigned to them under the Act.
3. Compulsory registration of marriages
Every marriage solemnized or contracted between citizens of India within the territory of the State of Madhya Pradesh under any law or custom governing such marriages shall be compulsorily registered in accordance with these rules.
5. Marriage Registrar
(1) The State Government may, by notification, appoint such Marriage Officers as it deems fit for the purposes of these rules as Marriage Registrars in Gram Panchayat or Municipality or Municipal Corporation or Cantonment Board areas. (2) Until a notification is issued under sub-rule (1), the local authority empowered to register births and deaths shall be the Marriage Registrar for the local area.
7. Registration of marriage
(1) (a) The parties to the marriage shall present a memorandum in Form 1 and either in person or by registered post, within a period of thirty days from the date of marriage, to the Marriage Registrar within whose jurisdiction the marriage was solemnized or contracted, in two copies. (b) The Marriage Registrar may accept the memorandum of marriage beyond the prescribed limitation, if the party to the marriage proves that it was prevented by sufficient causes beyond their control. (c) After examining the memorandum presented by the parties, the Marriage Registrar shall enter the entries in the register specified in Form 2. (d) Each memorandum entered in the register shall be considered a separate entry and every entry shall be numbered in a serial order which shall commence and end with each calendar year and a new serial shall commence at the beginning of each calendar year. (2) Where the Marriage Registrar to whom the memorandum has been presented, on scrutiny of documents presented with the memorandum or on any other fact coming to his knowledge or noticed, is satisfied or has reason to believe that: (a) the marriage between the parties has not been solemnized according to any law in force; (b) the marriage between the parties has not been solemnized according to the personal law of the parties; (c) the identity of the parties or the persons identifying the parties or the solemnization of the marriage cannot be proved beyond reasonable doubt; or (d) the documents presented before him do not satisfy the marital status of the parties, he may, after hearing the parties and recording the reasons, refuse to register the marriage; And (one) he may require the parties to furnish such additional information or documents as he deems necessary for verifying the identity of the parties and witnesses or the accuracy of the information or documents presented; or (two) if deemed necessary, he may direct the local police station within whose jurisdiction the parties reside, for verification. (3) Where under sub-rule (2) and upon verification, the Marriage Registrar is satisfied that there is no objection to register the marriage, he shall register it, and if he deems it not proper to register the marriage, he may pass an order refusing to register by recording the reasons. (4) The registration of marriage or refusal to register marriage under sub-rule (3) shall be done within a period of two months from the date of receipt of the memorandum of marriage. (5) Upon dissolution of a marriage registered under sub-rule (3), it shall be mandatory for either of the parties to the marriage to intimate the details of dissolution to the Marriage Registrar, and upon receipt of such details, the Marriage Registrar shall enter such details in column (16) of the marriage register specified in Form 2. If any person requests for a copy of the marriage registration certificate after dissolution of marriage, the fact of dissolution shall be mentioned in the marriage registration certificate.
10. Register of marriages
(1) The Marriage Registrar shall maintain a register of marriages solemnized or contracted, in Form 2, in the local area for which he is appointed and shall enter the details given by the parties in the memorandum and authenticate it. (2) Upon payment of a fee of Rs. 30, the Marriage Registrar shall issue a certificate of registration of marriage and the second copy of the certificate, when required, in the form prescribed in Form 3. The certificate of registration of marriage shall be issued in Hindi, but if a party to the marriage requests for an English copy, it shall be provided. (3) The certificate of registration of marriage, if requested by any party to the marriage, shall be sent by registered post to the address given by the applicant, and the postal charges shall be borne by the applicant.

The register of marriages shall be open for inspection at all reasonable times, and upon application, certified extracts thereof shall be given to the applicant by the Marriage Registrar upon payment of a fee of Rs. 20.

No employer or Government or semi-Government authority or company or public undertaking or local authority shall make any change in their office records or any official document, such as a change in the marital status of their employee or a change in nomination, unless the employee or the applicant seeking to implement or record such change produces a certified copy of the marriage registration certificate granted under sub-rule (2) of Rule 9 or any other marriage registration certificate granted under any other law for the time being in force.
13. Penalty for making false statement in memorandum of marriage
Any person who makes a false statement in the memorandum of marriage or verifies it, knowing or having reason to believe it to be false, shall be punished in accordance with the law for the time being in force.

Whoever destroys or tampers with the register shall be punished in accordance with the law for the time being in force.
