1. Short title, extent and commencement.
(1) This Act may be called the M.C. Rashtriya Patrakarita Vishwavidyalaya Adhiniyam, 1990. (2) It extends to the whole of the State of Madhya Pradesh. (3) It shall come into force on such date as the State Government may, by notification, appoint.
2. Definitions
In this Act, unless the context otherwise requires, - (a) "Academic-Council" means the Academic-Council of the Vishwavidyalaya, (b) "Authority" means the Authority of the Vishwavidyalaya, (c) "Vishwavidyalaya" means the Vishwavidyalaya of this Act, (d) "Executive Council" means the Executive Council of the Vishwavidyalaya, (e) "Finance Committee" means the Finance Committee of the Vishwavidyalaya, (f) "Statutes" means the Statutes of the Vishwavidyalaya as defined in sub-section (1) of section 3, (g) "Government" means the Government of this Act, (h) "Vishwavidyalaya" means the Makhanlal Chaturvedi Rashtriya Patrakarita Avam Sanchar Vishwavidyalaya established and incorporated under section 3 of this Act as incorporated in the Madhya Pradesh Vishwavidyalaya (Amendment) Ordinance 2006 (No. 8 of 2006) wherein it is known as "Makhanlal Chaturvedi Rashtriya Patrakarita Avam Sanchar Vishwavidyalaya" (i) "Finance Officer" means the Finance-Officer of the Vishwavidyalaya.
3. Establishment and incorporation of the Makhanlal Chaturvedi Rashtriya Patrakarita Avam Sanchar Vishwavidyalaya
(1) There shall be established in the Madhya Pradesh State, a Vishwavidyalaya by the name of the "Makhanlal Chaturvedi Rashtriya Patrakarita Avam Sanchar Vishwavidyalaya" which shall consist of an Academic Council, Executive Council and Finance Committee. (2) The Vishwavidyalaya shall be a body corporate by the name of the Vishwavidyalaya and shall have perpetual succession and a common seal, and shall sue and be sued by the said name and shall be competent to acquire and hold property. (3) The Vishwavidyalaya shall have the power to hold and dispose of property, both movable and immovable and to contract and shall do all other things necessary for the purposes of this Act and shall in the said name sue or be sued. (4) The headquarters of the Vishwavidyalaya shall be at Bhopal.
4. Objects of the Vishwavidyalaya
The objects of the Vishwavidyalaya shall be :- (a) To provide for instruction, teaching, training and research in Journalism and communication in the State of Madhya Pradesh, (b) Promote the study of Journalism and communication, (c) Provide for studies in the field of journalism and communication, (d) To provide for study of Journalism and communication, (e) Advance dissemination of knowledge, and (f) To promote such other objects as the Vishwavidyalaya may deem fit.
5. Powers and functions of the Vishwavidyalaya
(a) To provide for instruction, teaching, training and research as the Vishwavidyalaya may deem fit, (b) To hold examinations and to grant degrees or other academic distinctions to persons who have pursued a course of study provided by the Vishwavidyalaya, (c) To confer honorary degrees or other distinctions, (d) To provide for instruction and training for such branches of learning as the Vishwavidyalaya may deem fit, (e) In accordance with the statutes to provide for institutions of awards, (f) To maintain and manage the Vishwavidyalaya, (g) To accept grants from the Government and to manage its funds, (h) To provide for employment of such persons as the Vishwavidyalaya may deem fit for the purposes of the Vishwavidyalaya, (i) Teaching, journalistic, administrative, academic and other duties for which the Vishwavidyalaya may make ordinances, (j) To maintain and manage the Vishwavidyalaya in academic matters and to ensure the standards of the academic council, (k) To provide for the establishment, maintenance and management of the teaching departments, (l) To provide for the benefit of the Vishwavidyalaya, (m) To enter into agreements and to provide for such administrative activities as the Vishwavidyalaya may deem fit, (n) To supervise the work of the students and to provide for all other necessary arrangements, (o) To frame and conduct the courses and examinations in accordance with the regulations, (p) To appoint the teachers and to provide for the discipline required, (q) To prepare the annual accounts and balance sheets.
6. Powers of the Vishwavidyalaya to provide for instruction and research and to make provision for matters ancillary thereto.
The Vishwavidyalaya shall have the following powers to provide for instruction and research and to make provision for matters ancillary thereto, namely: to provide for instruction in such branches of learning, as the Vishwavidyalaya may think fit, and to make provision for research and for the advancement and dissemination of knowledge.
7. Admission of students.
(1) The Vishwavidyalaya shall be open to all persons of either sex and of whatever race, creed, caste or class and it shall not be lawful for the Vishwavidyalaya to adopt or impose on any person any test whatsoever of religious belief or profession in order to entitle him to be admitted therein as a student or to hold any office therein or to graduate thereat or to enjoy or exercise any privilege thereof. (2) Nothing in this section shall be deemed to prevent the Vishwavidyalaya from making special provisions for the admission of students of the weaker sections of the society and in particular of the scheduled castes and the scheduled tribes.
8. Kulapati of the Vishwavidyalaya.
(1) The Governor shall be the Kulapati of the Vishwavidyalaya. (2) Kulapati - (i) shall preside over the convening sessions, (ii) shall have the power to administer and regulate the affairs of the Vishwavidyalaya and any of its departments, (iii) shall have the right to inspect any department or institution on the Vishwavidyalaya, (iv) shall have the power to pass orders as he may deem fit for the working of the Vishwavidyalaya and its departments, (v) any such order or decision shall be communicated for compliance and implementation to the Registrar, who shall ensure its execution. (3) The Registrar shall, within a reasonable time, report the action taken on such order to the Kulapati.
9. Powers of officers of the Vishwavidyalaya.
The Vishwavidyalaya shall have the following officers, namely: (i) Kulapati, (ii) Kul-sachiv, (iii) Vyakhya-dhyan, and (iv) any other officer which may be conferred under the Adhiniyam.
10. Kulapati.
(1) The Kulapati of the Vishwavidyalaya shall be appointed by the Kuladhipati in accordance with the Vidhayaka. (2) Notwithstanding anything contained in this Act, the Kulapati shall have the power to administer the Vishwavidyalaya and to ensure that the provisions of the Adhiniyam are being complied with. (3) The Kulapati shall be a person of eminence in the field of journalism and communication. (4) Kulapati - (k) shall ensure that the provisions of this Adhiniyam are carried out, (kh) shall act as the head of the Vishwavidyalaya, (g) shall supervise the work of the Vishwavidyalaya and its departments. (gh) shall perform all such duties as are prescribed under this Adhiniyam. (5) In the event of a vacancy, the senior most professor shall discharge the duties of the Kulapati. (6) If the Kuladhipati is not satisfied with the performance of the Kulapati, he may initiate proceedings for his removal. (7) Failure to perform duties as per sub-section (5) or (6) shall be grounds for such action. (8) Kulapati - (i) shall preside over meetings, and (ii) shall perform all such duties as prescribed under the Adhiniyam.

19. Meetings of Academic Council

20. Academic Council
The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act and the Statutes, have the control and general regulation of, and be responsible for the maintenance of standards of teaching, research and examinations and for the teaching of such subjects as may be prescribed by in the Statutes and shall exercise such other powers and perform such other duties as may be conferred or imposed upon it by the Act and the Statutes.
21. Board of Studies
The University may have such Boards of Studies as may be prescribed by the Statutes for such other subjects as the University may determine, and for such other subjects as might not have been included in the Executive Council and for which the Academic Council deems it necessary to constitute a Board of Studies.
22. Finance Committee
The Finance Committee shall be a body as prescribed by the Act or Statutes and shall have powers and functions to advise the government as prescribed by the Act. The Finance Committee shall oversee the financial functioning and accounts and shall be the principal financial advisory body.
23. Other Authorities
(1) The establishment of other authorities of the University and their constitution as bodies shall be published and their functions shall be conferred by such other powers as may be prescribed by the Executive Council.
24. Powers and Duties of the Academic Council
The Academic Council shall have the following powers and duties, namely: (i) to control, maintain and advise on the standards of teaching and research; (ii) to make regulations for the admission of students, to the courses of study, and to the degrees and diplomas, of the University: Provided that the Academic Council shall not have the power to make regulations on matters governed by the Act, or by the Ordinances. The Academic Council shall not be empowered to make any regulation which would reduce the number of hours of study or the number of periods or courses of instruction below those prescribed under the Act.
25. Powers of the Academic Council regarding Courses
(1) The Academic Council shall have the power to prescribe courses of study and, in the exercise of these powers, to maintain the standards of teaching, research and examinations, as well as the power to make regulations for the conduct of examinations, the appointment of examiners and the maintenance of discipline.
26. Section 26
(2) The Planning Board shall consist of the following: (a) Kulpati, (b) members of the Academic Council, (c) University Registrar, (d) a nominee of the Kuladhipati, (e) other academic staff, (f) other members as prescribed, (g) finance officer, (h) an expert nominated by the Kuladhipati, (i) representative of the teaching staff, and (j) any other as prescribed.
27. Transitional Provisions
(2) Notwithstanding any thing contained in the Madhya Pradesh Vishwavidyalaya Adhiniyam, 1973, any college or institution affiliated to or seeking affiliation with any other University may be admitted to the privileges of the University in respect of journalism and communication or related subjects as may be prescribed by the Statutes or Ordinances. (3) Notwithstanding anything contained in the Statutes or Ordinances, any person who immediately before the commencement of this Act was in the employment of the University may continue in such employment on the same terms and conditions as applicable to him under the previous Statutes or Regulations.
28. Vishwavidyalaya ki Samitiyan
(1) Vishwavidyalaya kisi kramik varg ko suchi, jaisa samalan ki prapti par, kintu kam se kam 15 din suchi atya samalan karayega. (2) Vishwavidyalaya ke kisi samalan ke liye kary-suchi suchi ke gatya kram karne, sadasyon ki kuli sankhya ke ek triyansh se banegi aur atya suchi gatya kram ke alava, us suchi ke samalan ko usi samay usi kramik suchi (avishya) se samapan hone ke purv amne pradhan ke liye samay mil sakega: kintu kramik samalan ke liye koi gatya kram atyant na banega. (3) Pratinik sankhya ka ek mat hoga. Isse avishya ke antargat upsamiti ka salay isse avishya koi bhi Vishwavidyalaya ke kisi samalan ke samik se bahar koi samya patra upsamitiyon ko shradhipur dwara vanyas kiya banenge aur maton ke sadashay hone ki dasha mein samalan ki adhikar kary karne layak patra mat hoga. (4) Vishwavidyalaya ki pratinik samalan ki adhikar sanchalan dwara kiya banega ya uske anupriti mein koi sankhya dwara kiya banega jaisa uttar par adhikari karne ke liye samalan dwara saka jaye. (5) Yadi Vishwavidyalaya dwara takalaukaryaa kiya karne atyant bane gaye ki Vishwavidyalaya ke sanchalan, kulshasan samiti ko samalan dwara kary-kary ke anu yay na bane unka anu ya naye unka kram vish vishwavidyalaya ke alamiya shukra ke samik pust ke liye raje banenge.
29. Parishad Samiti
Ek Parishad Samiti banega jabke sarvsachiv sankhya banenge :- (ek) Mantrimantralaya ka mukhy mantri parishad samiti ka sabhapati banega, (do) Sachiv-mantri, vak, mantrimantralaya sachiv, (teen) Vishwavidyalaya ka kulpati, (char) Sachiv, vishwavidyalaya paramarsh, mantrimantralaya sachiv, (panch) Vishwavidyalaya ka kul-sachiv, tatha (chah) Vishwavidyalaya ke anya sankhya, jaisa Vishwavidyalaya dwara nam-naman kiya banenge.
30. Parishad Samiti ki
(1) Parishad Samiti, prashasanik niyantra samitiyon par uska saman adhyaksh tatha kintay tak pradhar karega aur avishya lenga, jabke samay tak ya usme vishwavidyalaya dwara pratinam kiya banenge. (2) Parishad Samiti apni adhyaksh kisi-samiti ya kul-sachiv ko us samay tak pratinam dary karega, jabke samay tak ya uska karne vanyas kare.
31. Parishad Samiti ki
(1) Parishad Samiti ka samalan kul-sachiv dwara sulayenga samalano ki prapti kam se kam ugh: sabra mein kam se kam ek suchi atya samalan karega. (2) Parishad Samiti ke sankhya ka purvava, vishwavidyalaya mein uske avay ka samnan banega. (3) Parishad Samiti ke samya vanya upsamitiyon ko shradhipur dwara kiya banenge. (4) Sabhapati ki anupreeti mein Parishad Samiti ka kisi samalan ki adhikar samiti dwara nanyas-sati kiya sankhya dwara banega. (5) Samiti ka samalan sulayenge ke liye kul-sachiv samay naye ki samichi naye. (5 ka) Parishad Samiti ke samalan ki gatya kram, sankhya ke kuli sankhya ke ek triyansh se banega aur atya gatya kram ke alava, us samiti ke samalan ko usi samay, usi kramik suchi (avishya) se samapan hone ke purv amne pradhan kiya kar naye banega: kintu samalan ke liye koi gatya kram atyant na banega.
32. Vitt Samiti
(1) Vishwavidyalaya dwara sansthapit kram sadhar ek vitt samiti gathit kiyega, antargat :- (ka) Vishwavidyalaya ka kul-sachiv, (kha) Kul-sachiv, (ga) Sachiv, mantrimantralaya sachiv, vishwavidyalaya paramarsh tatha up-sachiv sa anya katha dhani ka uska nam-naman naye, (gha) Vishwavidyalaya ke anya sankhya, jaisa Vishwavidyalaya dwara nam-naman kiya banenge, (nga) Sachiv, mantrimantralaya sachiv, vitt paramarsh tatha up-sachiv sa anya katha dhani ka uska nam-naman naye. (2) Vitt samiti ke sankhya prana banenge. (3) Vitt samiti ke kintay tatha kartavya niveshan banenge, antargat :- (ek) Vishwavidyalaya ka vaishik shul ka prachar tatha sam-vanchit kary-kary tatha vishwavidyalaya ko vittiya nam-naman par adhikarikary-kary. (do) Kar-kal kanyon ko vanya par pradhar kariyega tatha samya-samya par Vishwavidyalaya ka vitt ka chuny-vanchit kary-kary tatha chuny-vanchita kanyon vanya tatha sam-samya puste par pradhar kariyega tatha vishwavidyalaya ko adhikarikary-kary. (teen) Vishwavidyalaya ko, Vishwavidyalaya ka bhava prachar ke liye kisi vittiya bhaya par ya jaisa samay ki phalta par tatha vishwavidyalaya tatha kul-sachiv ke naye par, apne pradhar tatha adhikarikary-kary naye. (4) Vitt samiti ka samalan varg mein kam se kam 21 ek suchi banega v vitt samiti ke teen sankhya mein gatya kram banega. (5) Sankhyaon ki sans-mati samya hone ki dasha mein, upsamiti sankhyaon ko shradhipur ka pati avashya-pati banega.
33. Sayan Samiti
(1) Vishwavidyalaya, aaydaya, sam-aaydaya, avayaviyon tatha aviyaya sthar ke apne karmsharye vanya ke naye ko laine Vishwavidyalaya ko adhikariyatary-kary ke purv sayan samitiyon ka gathit kariyega. (2) Sayan samiti mein sansthapit sankhya banenge :- (ka) Kul-sachiv, jaisa samiti ka sanchalan banega. (kha) Mantrimantralaya ka Vishwavidyalaya ka kul-sachiv jaisa vishwavidyalaya, ka ek sankhya banega. (ga) Vishwavidyalaya, mein baibindal gella ka praty. (pa) Sam-vanti paramarsh-vanya, yadi koi ho, pashchat yadi anya katha jaisa ke liye sayan kiya naye, kintu kathatara ka naye dharma na kariyega. (nga) Aaydaya, sam-aaydaya tatha samiyayik aaydaya ke sayan ke liye naye anya vachaya, jaisa vishwavidyalaya dwara nam-naman kiya banenge. (chah) Sachiv, mantrimantralaya, vitt paramarsh. (3) Sayan samiti ka samalan, yadi kuch atyant banega, kul-sachiv dwara, sulayenga banega sayan samiti ke samalano ki adhikariya kul-sachiv dwara banega.
34. Vishwavidyalaya ki
(1) Vishwavidyalaya ki ek ni banega, jismen sansthapit ni-kanya samampat banenge :- (ka) Rashra sachiv dwara kiya gaya gella koi anya-ntay tatha avayay, (kha) Vishwavidyalaya avayay amaigne tatha kaypan sachiv dwara kiya gaya gella koi anya-ntay tatha avayay, (ga) Sambhavnya ikaye ke up-kanyon dwara kiya gaya gella koi anya-ntay, (pa) Pamyalint vanyaon tatha sam-mantriyon dwara ki gayi gella koi lanti, kiya gaya gella anya-ntay, ayavanti tatha apne avayay, (nga) Vishwavidyalaya dwara prash-tatha parir-va mein parit anya, tatha
35. Academic Council
(1) The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act and the Statutes, coordinate and exercise general supervision over the academic policies of the University. (2) The Academic Council shall be responsible for the maintenance of standards of instruction, education and examination within the University. (3) The Academic Council shall have the right to advise the Executive Council on all academic matters, including the prescription of courses of study and the maintenance of standards of instruction and examinations held by the University. (4) The Academic Council shall consist of such members as may be prescribed by the Statutes, but shall include the Vice-Chancellor, such Deans of Faculties as may be prescribed and such other members as may be prescribed. (5) The Academic Council may, from time to time, frame academic regulations and make such regulations as it thinks fit.
36. University Regulations
(1) The Academic Council shall have the powers to make, amend, or repeal University Regulations, subject to the provisions of this Act and the Statutes, with the approval of Executive Council. (2) Each such Regulation shall be placed before the Executive Council, and the Executive Council may approve the Regualtion or return it to the Academic Council for reconsideration. (3) Regulations made by the Academic Council shall be effective once approved by the Executive Council. (4) The period of operation of the Regulation shall be decided by the Vice-Chancellor, and the Regulation, as approved by the Vice-Chancellor, shall be published in the Madhya Pradesh Gazette.
37. Committees
The University may, as and when necessary, constitute such committees for carrying out the provisions and objectives of the University as it may deem fit, as per the Statutes or the authorities empowered by this Act.
38. Delegation of Powers
Any authority or officer of the University may, by notification, delegate their powers to any subordinate authority or officer, as per the provisions of the Act.
39. Annual Report
The University shall, as soon as may be, prepare the annual technical and administrative reports, including the accounts for the previous year, as prescribed.
40. Financial Estimates
The Finance Officer of the University or any other officers as appointed by the Executive Council shall prepare the finance estimates and financial statements for evaluation, and based on these, the budget and final estimates are prepared which are then approved by the Executive Council or such authority as the Academic Council may deem fit.
41. Accounts and Audit
(1) The Academic Council shall prepare the annual accounts and balance sheet for each financial year. Any deficiency, accounts, balance sheets or account statements placed before the University shall be audited by the auditors appointed by the Executive Council, unless the audit is conducted by the State Government or by any authority appointed by the State Government. (2) No person shall be appointed as an auditor if they have any direct or indirect interest in the University. (3) The Academic Council shall submit a copy of the annual accounts to the State Government. (4) The report of the auditor shall be placed before the Executive Council for consideration.
42. Admission of Students
(1) The University shall keep its admissions open for all persons of either sex and of whatever race, creed, caste, or class, subject to the provisions of this Act. (2) No person shall be denied admission to any course of study or barred from the University on the grounds of religion, race, caste, sex, or place of birth, provided that the person meets the requirements for admission as prescribed by the Executive Council.
43. Vacancies in Bodies
If any vacancy occurs in any authority, University, or body, the vacancies shall be filled by persons who are eligible for the same, and if no such person is available, then: (a) The person so appointed shall hold office as per the rules and regulations. (b) The vacancy shall be filled for the remaining period according to the regulations.
44. Disqualification
A person shall be disqualified from holding office if they are a convicted person under the laws or have been declared insolvent by a court.
45. Protection of Official Acts
All acts done by the University or its authorities, committees, or officers in good faith shall be protected from any legal challenge.
46. Resolution of Disputes
Disputes regarding any administrative, session or council matter shall be referred to the appropriate authority as designated by this Act.
47. Power to Remove Difficulties
(1) If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order, remove such difficulty. (2) No such order shall be questioned in any court.
48. Transitory Provisions
Notwithstanding anything contained in this Act, the University shall continue to operate and perform its duties as per this Act and the rules or regulations until such time as the Statutes or Ordinances are framed under this Act.
49. Savings
All orders, rules, and regulations made under this Act remain valid until superseded by this Act.
50. Protection of Actions
No suit or legal proceeding shall be initiated against any officer or the University for any act done in good faith.
51. Power of State Government
The State Government may exercise its authority over the University to ensure the proper implementation of the provisions of this Act.
