This Act may be called the Madhya Pradesh Lok Sewa (Anusuchit Jatiyon, Anusuchit Janjatiyon Aur Anya Pichhda Vargon Ke Liye Arakshan) Sansodhan Adhiniyam, 2002.

Mul adhiniyam ki dhara 3 mein, pad (2) tatha (4) ka lop kiya jaye. In section 4 of the Principal Act, in sub-section (1) for the words "six percent" the words "fourteen percent" shall be substituted.

Mul adhiniyam ki dhara 6 ki up-dhara (1) ke sthan par nimnalikhit up-dhara sthapit ki jaye arthath:- '(1) Koi niyukti pradhikari jise dhara 5 ki up-dhara (1) ke adhin uttar-dayitva sompa gaya hai, aisi sthiti mein janbujhkar karya karta hai jo is adhiniyam ke prayojanon ka ullanghan karne ya unhe vifal karne ke liye ashayit hai ya dhara 14-ka ke nibandhanon ke adhin mithya praman-patra ka prishthankan karta hai, niyukti pradhikari ka aisa kritya uspar laghu aacharan ya seva niyamon ke adhin avachar samjha jayega aur aise avachar ke liye un niyamon ke adhin anushasanik karyavahiyon ke sath saksham adhikarta wale kisi nyayalaya dwara abhishapit kiye jane ka dayi hoga aur vah doshsiddhi par karavas se, jo ek varsh tak ka ho sakega ya jurmane se jo do hazar rupaye tak ka ho sakega, ya dono se dandaniya hoga.' In section 8 of the principal Act, for the proviso, the following proviso shall be substituted, namely:- "Provided that the State Government may, by order, make provision for nomination of officers belonging to the Scheduled Castes, the Scheduled Tribes and other Backward Classes in the Selection/Screening Committee, by whatever name it is called, where such Committee is constituted for the purpose of selecting persons for appointment or promotion to the posts or services, either under the service rules or otherwise, to such extent and in such manner as it deems necessary."

(1) This Act may be called the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, ‘Anusuchit Short title and . Janjatiyon Aur Anya Pichhade Vargon Kc’ Liye Arakshan) Sanshodhan Adhiniyam, 2002. Commencement. : : (2) It shall come into force on such date as the ‘State ‘Government may. by ‘notification, - “ apppint. . : : 2. In Section 2 of the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Janjatiyon Amendment of Auf Anya Pichhade Vargon Ke Liye: Arakshan) Adhiniyam. 1994 (No. 21 of 1994) (hereinafter Section 2- : refered to as the Principal Act), for clause (b), the following clause shall be substituted, namely — . . “(b) "Establishment" means any office of the State Government or of a local authority or | statutory authority’ constituted under any Act of the State for the time being in . force, or a University or a company, corporation or a Co-operative society in . . which not less than fifty onc percent ‘of the paidup share capital is held by the Statc Government or the institutions receiving grant-in-aid or any cash grant from . the State Government and includes a work charge or contingency paid : . establishment and such establishment in which casual appointments are made but : . does not include the establishments covered under Article 30 of the Constitution.” 3. InSection 3 of the Principal Act, item (2) and (4) shall be omitted. Amendment of .
