Bare Act
The Registration (Kerala Amendment) Act, 1998
General19982 sections
This Act amends the Registration Act of 1908 to allow the state to recover unpaid or underpaid registration fees. If a document is registered but the fee is missing or too low due to incorrect property value, the government can recover the money. This is done by issuing a certificate from the Inspector General of Registration, which treats the unpaid amount as a land revenue arrears under the Revenue Recovery Act. However, the person must be given a chance to be heard during an enquiry, and the recovery must be completed within three years of the document being presented for registration.
