The Judicial Proceedings (Validation) Act, 1971
General19712 sections
The Judicial Proceedings (Validation) Act, 1971 protects past legal decisions made by District Courts in Kerala regarding land acquisition cases. Under the Kerala Land Acquisition Act of 1961, appeals concerning decisions of Subordinate Judges should have been brought directly before the High Court. However, many appeals were mistakenly filed in and decided by District Courts instead. This law validates all those district court proceedings, decrees, and orders, ensuring they are legally binding and cannot be overturned simply because the District Courts originally lacked the authority to hear them. It provides legal certainty and relief to affected property owners and government authorities.
