The Indian Easements (Extension) Act, 1961

Civil19615 sections

The Indian Easements (Extension) Act, 1961 unifies property rights law across the State of Kerala by extending the Indian Easements Act, 1882 to the entire state. Previously, the 1882 law applied only to the Malabar region, while the Travancore-Cochin area followed a separate local law from 1951. By repealing the older Travancore-Cochin law, this legislation creates a single, standardized framework governing easements—such as rights of way, access to light, air, and water—for all property owners and residents in Kerala. It ensures that existing legal rights, ongoing court proceedings, and prior actions remain valid while establishing uniform property usage rules statewide.
