The Jharkhand State University (Amendment) Act, 200210. Substitution of the following part of Section-57A Sub-section-(1) ofJharkhand State Universities ACT, 2000 (Adapted and as Amended) "Appointment of teachers of affiliated Colleges not maintained by the State Government shall be made by the Governing Body on the recommendation of the Jharkhand Public Service Commission. Dismissal, termination, removal, retirement from service or demotion in rank of teacher of such colleges shall be done by the Governing Body in consultation with the Jharkhand Public Service Commission in the manner prescribed by the Statutes: Provided that the Governing Bodies of affiliated Minority Colleges based on religion and language shall appoint, dismiss, remove or terminate the services of teachers or take झारखडगजट(असाधारण) शु,वार, 15 फरवर/, 2019 disciplinary action against them with the approval of the Jharkhand Public Service Commission. Provided further that the advice of the Jharkhand Public Service Commission shall not be necessary in cases involving censure, stoppage of increment or crossing of efficiency bar and suspension till investigation of charges is completed." Be substituted by the following provision:- Substitutionof the above part in Sub-Section (1) of Section-57A "Appointment of teachers of affiliated Colleges not maintained by the State Government shall be made by the Governing Body on the recommendation of the Jharkhand Public Service Commission. Provided that the Governing Bodies of affiliated Minority Colleges based on religion and language shall appoint, dismiss, remove or terminate the services of teachers or take disciplinary action against them with the approval of the Jharkhand Public Service Commission. Provided also that in case of affiliated colleges not maintained by the State Government including Religious and Linguistic Minority Colleges, the promotion of teachers shall be made on the recommendation of Jharkhand Public Service Commission. For this purpose it shall invite application as per the requisition sent by University from only such candidates who fulfil the prescribed qualifications as laid down in the Statute framed in this regard. However, such test shall be conducted having regard to any regulation framed or direction issued by the University Grants Commission in this regard; धारा-57 कȧ उपधारा-2(b) Ǔनàन ǽप से ĤǓतèथाͪपत हो- For appointment of teachers in the University and Constituent Colleges the Commission shall invite applications from candidates who have passed the Jharkhand Eligibility Test (JET) conducted by JPSC and/or have cleared the National Eligibility Test (NET)/Junior Research Fellow (JRF) conducted by the UGC/CSIR and/or have been awarded Ph.D. degree in the relevant subject in accordance with the Statute in this regard as per University Grants Commission Regulations and on the basis of interview shall prepare merit list against the vacancies sent by the University and such list shall remain valid for a period of one year from the date of its approval. The merit list shall consist of twice the number of vacancies, but the Commission shall send in order of merit only one name at a time to the University for Appointment against a single vacancy. Provided that the Commission shall recommend names to the University from the merit list in conformity with the reservation roster prepared and sent by the University in accordance with the law relating to reservation in appointment in force in the State for Universities of Jharkhand considering University as one unit. धारा-57 कȧ उपधारा-5 Ǔनàन ǽप से ĤǓतèथाͪपत हो- Notwithstanding anything to the contrary contained in the Act, Statutes, Rules or Regulations, the policy of reservation in the State of Jharkhand for the Universities of Jharkhand shall apply to all appointments for teacher of University considering University as one unit. झारखंड राÏयपाल के आदेश से, नͧलन कुमार, Ĥधान सͬचव-सह-ͪवͬध परामशȸ ͪवͬध ͪवभाग, झारखंड, राँची । -------- झा झारखÖड राजकȧय मुġणालय रखÖड राजकȧय मुġणालय, राँची ɮवारा Ĥकाͧशत एवं मुǑġत राँची ɮवारा Ĥकाͧशत एवं मुǑġत, असाधारण) ) 468 – 50 Jharkhand State University (Amendment) Act, 2024 Act for amendment in Jharkhand State University Act 2000 (adopted and as amended) PREAMBLE The state government is determined to promote education and strengthen colleges in the state. In the light of the National Education Policy (NEP)-2020, significant efforts are being made in the field of higher education with the aim of achieving the Gross Enrolment Ratio (GER) up to the national level and providing maximum employment opportunities to the students. In this sequence, according to the National Education Policy (NEP)-2020, by the year 2030, a large multi-disciplinary university has been envisaged in each district. Presently there is no university in Giridih district. There are a total of 05 constituent colleges, 10 affiliated colleges and 07 teacher training colleges in Giridih district. All the colleges located in the district are governed by Vinoba Bhave University, Hazaribag. The distance of Vinoba Bhave University, Hazaribag from Giridih is around 115 kilometres, as a result the development of Higher Education in Giridih district has not been satisfactory. The Gross Enrolment Ratio (GER) of Giridih in the year 2019 was found to be 11.71 which is much lower than the national and state average. Low GER indicates that a large population of youth (age gap of 18-23) in this district is away from higher educational. Due to the distance of Vinoba Bhave University, Hazaribagh from Giridih, higher educational institutions of the district have been neglected and the development of higher education has not been satisfactory. Giridih district has been listed as an aspirational district by NITI Aayog on the basis of unsatisfactory condition of health and education in the district. This district has remained affected by Naxalite activities for a long time, hence the pace of development has been slow. It is one of the backward districts of the state with problems of poverty, unemployment, migration, education and health. A large part of the population mostly youths migrate to other states in search of employment and better education. Most of the population migrates to West Bengal, Bihar and Uttar Pradesh. Great scientist Sir JC Bose had a special attachment to Giridih district. With the establishment of a university in his name in this district, a new energy will be infused in the youth. Along with this, it will help in providing access to higher education to the youth of this district and create employment opportunities for them. It is to mention that from geographical point of view, the nearest district of Giridih is Koderma. There are total 02 constituent and 09 affiliated colleges under Koderma district, which are governed by Vinoba Bhave University, Hazaribagh. It is also noteworthy that there are total 05 districts under the jurisdiction of Vinoba Bhave University, Hazaribagh. The Gross Enrolment Ratio (GER) in Koderma in the year 2019 is 11.26, which is lower than the national and state average. From a geographical standpoint, Koderma is adjacent districts to Giridih district. To ensure that students in these districts have access to a better education system, it appears expedient to place the jurisdiction of all colleges located in Koderma district under Sir J.C. Bose University, Giridih. To fulfill this purpose, establishment of "Sir JC Bose University" in the state of Jharkhand and according to it amendment in the Jharkhand State University Act, 2000 (adopted and as amended) is proposed. Be it enacted by the Legislature of the State of Jharkhand in the 75th Year of the Republic of India as follows:- Chapter-1 4. Short title, extent and commencement (1) This Act may be called the "Jharkhand State University (Amendment) Act, 2024". (2) It shall extend to the whole of the State of Jharkhand. (3) It shall come into force at once. Chapter-2 5. Substitution of sub-section 1(f) of Section-3 (Establishment and Combination of Universities) of Jharkhand State University Act, 2000 (adopted and as amended):- Current provision in sub-section (1) (f) of the section-3 (Establishment and Combination of Universities).:- "Vinoba Bhave University having the headquarters at Hazaribagh and the jurisdiction over the whole of the North Chhotanagpur Division except Dhanbad and Bokaro District. Provided that the territorial jurisdiction shall extend to the whole of State of Jharkhand in matters pertaining to educational institutions imparting teaching in Homeopathy, Indigenous medicines and educational institutions imparting academic distinction in Pali, Prakrit and such other languages which the University may consider necessary. The educational institutions imparting academic distinction in Sanskrit which comes under the territorial jurisdiction of Vinoba Bhave University, Hazaribagh, will now come under the jurisdiction of this “Baba Baidhayanath Sanskrit University having the headquarters at Deoghar, Jharkhand.” The said provision shall be substituted by the following provision as - Substitution of sub-section (1) (f) of Section-3 (Establishment and Combination of Universities). "Vinoba Bhave University having the headquarters at Hazaribagh and the jurisdiction over the whole of the North Chhotanagpur Division except Dhanbad, Bokaro, Giridih and Koderma Districts. Provided that the territorial jurisdiction shall extend to the whole of State of Jharkhand in matters pertaining to educational institutions imparting teaching in Homeopathy, Indigenous medicines and educational institutions imparting academic distinction in Pali, Prakrit and such other languages which the University may consider necessary. Inclusion of sub-section (1) (s) of Section-3 (Establishment and Combination of Universities) of the Jharkhand State University Act, 2000 (adopted and as amended) The following provision shall be inserted: In the Jharkhand State University Act, 2000 (adopted and as amended), hereinafter referred to as the said Act, at the end of sub-section-1 (r) of section-3, the following sub-section (1) (s) of section 3 shall be inserted as- “3(1) (s) Sir J.C.
