(1) Save as otherwise provided in sub-section (2) no prosecution shall be instituted against any person for any offence under this Act, except on a complaint made by the prescribed authority or a Police Officer, not below the rank of Sub-Inspector. (2) Any offence relating to touting committed under this Act shall be cognizable and non-bailable.
