Bare Act

The Jammu and Kashmir Arya Samajist Marriage (Validation) Act, 1942

Civil19992 sections

This Act legally recognizes marriages between Arya Samajists regardless of caste or religious differences. It overrides any Hindu law or customs that would otherwise deem such marriages invalid. The legislation validates marriages already performed or future marriages between Arya Samajists, who follow the religious practices of the Arya Samaj movement within Hinduism. The law applies to the entire state of Jammu and Kashmir and extends to all residents outside the state who maintain state subject status. This legal recognition provides certainty and protection for Arya Samajists facing caste-based restrictions in traditional Hindu marriage practices.
