Bare Act
The Jammu and Kashmir Infant Marriages Prevention Act, 1928
General198511 sections
This Jammu and Kashmir law aims to prevent child marriages by setting legal minimum ages for both parties, with an infant girl being under eighteen and an infant boy under twenty-one years. The legislation imposes prison sentences of one year or fines up to a thousand rupees for marrying a minor girl, and up to four years or higher fines for men over fifty marrying a minor girl. The law also prohibits arranging such marriages and allows courts to issue injunctions to prevent child marriages, though spouses themselves aren't held responsible. Marriage ceremonies cannot proceed once a court has ordered an injunction against the marriage.
