Civil193311 sections
The Hindu Widow's Re-marriage and Property Act of 1933 is a special legislation enacted for the state of Jammu and Kashmir that seeks to protect and empower Hindu widows by revoking traditional judicial disabilities. It legally validates the remarriage of Hindu widows—previously barred under customs and interpretations of Hindu Law—ensuring that children born from such remarriages are not considered illegitimate. The Act also terminates a remarried widow's right to claim maintenance from her deceased husband's property, thereby preventing dependency on former connections. It applies throughout the state and came into operation immediately upon enactment.
