The Jammu and Kashmir Hindu Disposition of Property Act, 1940

This Act removes a major legal hurdle for Hindus in Jammu and Kashmir by permitting property owners and will-makers to legally gift or bequeath assets to individuals who do not yet exist at the time of the transfer (such as unborn children). By specifying that the validity of such future dispositions is not nullified simply because the beneficiary is unborn, the law grants certainty to estate planning. Additionally, the Act sets strict procedural boundaries for these gifts, requiring that they adhere to the restrictions outlined in Chapter II of the Jammu and Kashmir Transfer of Property Act of 1997.
