Bare Act
The Jammu and Kashmir Fatal Accidents Act, 1920
This Act establishes a legal framework enabling families of individuals who die from wrongful acts, negligence, or default in Jammu and Kashmir to receive compensation. It applies to anyone whose death results from another's legal responsibility, even if the incident involved criminal activity. The legislation allows surviving spouses, parents, and children to sue for monetary damages through an executor or administrator. These actions ensure financial recovery for the loss caused by another's wrongful conduct, with courts determining appropriate compensation proportional to the financial harm suffered by eligible family members. The law provides an essential remedy for wrongful deaths that might otherwise lack compensation avenues.
