The Jammu and Kashmir Buddhist's Polyandrous Marriages Prohibition Act, 1941
General19988 sections3 chapters
This Act prohibits Buddhist subjects in Jammu and Kashmir from practicing polyandry, which involves brothers jointly marrying a single woman, and criminalizes the custom of a "phursak" where a woman takes a second husband with her first husband's consent. The rule applies to all such families, and anyone over thirteen years old who contracts, directs, or facilitates illegal marriages now faces imprisonment of up to three years or fines to discourage the practice. Any union performed in violation of this legislation is declared void, replacing traditional customs with valid legal recognized marriages.
