Bare Act

The Jammu and Kashmir Arrest and Detentions (Validating) Act, 1949

General20064 sections

This Act applies to the whole of Jammu and Kashmir State. It validates detention orders and arrests made by unauthorized officers or officials between October 1947 and the Act's enactment, removing objections that they were illegal. Consequently, it bars all civil and criminal court proceedings against those officials for actions taken in good faith to maintain public order. The law provides a conclusive government certificate as proof that officials believed they had the authority to detain under the Public Security Act or Defence Rules during this period.
