Bare Act

The Himachal Pradesh (Restriction to Contest Alienation or Adoption under Custom) Act, 1976

General19768 sections

This law restricts who can challenge property transfers, wills, or customary adoptions made under local customs in Himachal Pradesh. It applies to individuals whose property decisions are governed by traditional custom rather than general personal law. Under this legislation, no one can contest the transfer of non-ancestral property or the appointment of an heir to it based on custom. For ancestral property, only direct male line descendants of the property owner's great-grandfather are allowed to bring a legal challenge. This Act matters because it provides security to property owners, limits legal interference by distant relatives, and reduces customary inheritance litigation.
