THE HIMACHAL PRADESH RESTITUTION OF MORTGAGED LANDS ACT, 1976
The Himachal Pradesh Restitution of Mortgaged Lands Act, 1976
General197616 sections
This Act helps people in Himachal Pradesh get their land back if they mortgaged it more than 20 years ago. It applies to agricultural land and related property. If the original owner applies to the local government, officials will check if the lender has benefited enough from the land. If the lender has not gained value equal to twice the original loan amount, the owner can regain possession and ownership. The law protects long-term land rights by ensuring lenders cannot keep property forever without providing sufficient benefit, though the owner may still need to pay compensation if the lender is still owed money.
