The Himachal Pradesh Regulation of Salaries and Allowances of different categories in Certain Exigencies Act, 2020
Chapter 1 PRELIMINARY
1. Short title and commencement
Short title and commencement.—(1) This Act may be called the Himachal Pradesh Regulation of Salaries and Allowances of different categories in Certain Exigencies Act, 2020.
- (2) It shall be deemed to have come into force with effect from the 11th day of April, 2020.

2. Amendment of section 3
Amendment of section 3.—In the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000 (11 of 2000) (hereinafter in this chapter referred to as the “principal Act”), in section 3, after sub-section (1), the following sub-section shall be inserted, namely:— “(1-A) Notwithstanding anything contained in sub-section (1), the salary payable to a Minister under sub-section (1), shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.”.

3. Amendment of section 4
Amendment of section 4.—In the principal Act, the provision of section 4, shall be numbered as sub-section
- (1) and thereafter, the following sub-section shall be inserted, namely:— “(2) Notwithstanding anything contained in sub-section (1), the sumptuary allowance payable to a Minister under sub-section (1), shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.”.

4. Amendment of section 3
AMENDMENT OF THE HIMACHAL PRADESH LEGISLATIVE ASSEMBLY SPEAKER’S AND DEPUTY SPEAKER’S SALARIES ACT, 1971
Amendment of section 4.—In the principal Act, the provision of section 4, shall be numbered as sub-section
- (1) and thereafter, the following sub-section shall be inserted, namely:— “(2) Notwithstanding anything contained in sub-section (1), the sumptuary allowance payable to a Minister under sub-section (1), shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.”.

5. Amendment of section 4
Amendment of section 4.—In the principal Act, in section 4, the sub-section (1-AA) shall be renumbered as (1-B) and thereafter, the following sub-section shall be inserted, namely:— “(1-C) Notwithstanding anything contained in sub-section
- (1) and (1-B), the salary and sumptuary allowance payable to the Deputy Speaker under sub-section
- (1) and (1-B), shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.”.

6. Amendment of section 3
AMENDMENT OF THE SALARIES, ALLOWANCES AND OTHER BENEFITS OF THE CHIEF WHIP AND DEPUTY CHIEF WHIP IN THE LEGISLATIVE ASSEMBLY OF HIMACHAL PRADESH ACT, 2018
Amendment of section 3.—In the Salaries, Allowances and other Benefits of the Chief Whip and the Deputy Chief Whip in the Legislative Assembly of Himachal Pradesh Act, 2018 (3 of 2018) in section 3, after sub-section (2), the following sub-section shall be inserted, namely:— “(3) Notwithstanding anything contained in sub-section
- (1) or sub-section (2), the salary and sumptuary allowance payable to a Chief Whip or a Deputy Chief Whip, as the case may be, shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.”.

7. Amendment of section 3
AMENDMENT OF THE HIMACHAL PRADESH LEGISLATIVE ASSEMBLY (ALLOWANCES AND PENSION OF MEMBERS) ACT, 1971
Amendment of section 3.—In the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 (8 of 1971) (hereinafter in this chapter referred to as the “principal Act”), in section 3, after sub-section (1), the following sub-section shall be inserted, namely:— “(1-A) Notwithstanding anything contained in sub-section (1), the salary payable to a member under sub-section (1), shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.”.

8. Amendment of section
Amendment of section 4-B.—In the principal Act, in section 4-B, after sub-section (1), the following sub-section shall be inserted, namely:— "(1-A) Notwithstanding anything contained in sub-section (1), the constituency allowance payable to a member under sub-section (1), shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic.".

9. Reduction of salaries of Chairmen, Vice-Chairmen of Boards or Corporations and political appointees etc
Reduction of salaries of Chairmen, Vice- Chairman of Boards or Corporations and political appointees etc.—(1) Notwithstanding, anything contained in any other law for the time being in force, the salary etc. payable to a Chairman, Vice-Chairman of a Board or Corporation; or any other political appointee shall be reduced by thirty percent. for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic: Provided that nothing contained in this sub-section shall apply to in service officers of the Government who are appointed or are officiating as a Chairman or a Vice-Chairman of a Board or Corporation: Provided further that the Government may, by order or as the occasion requires, do anything consistent, so far as may be, with the provisions of this Act, which appear to it to be necessary or expedient for the purpose of removing the difficulty. Every such order shall have effect as if such action had been taken under this Act.
- (2) All orders made under this Act shall be laid before the Legislative Assembly as soon as may be, after they are made.
Chapter VI MISCELLANEOUS
10. Act to have overriding effect
Act to have overriding effect.—The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or in any instrument having effect by virtue of any law other than this Act.

11. Repeal of the Himachal Pradesh Ordinance No. 1 of 2020 and savings
Repeal of the Himachal Pradesh Ordinance No.1 of 2020 and savings.—(1) The Himachal Pradesh Regulation of Salaries and Allowances of different categories in Certain Exigencies Ordinance, 2020 is hereby repealed.
- (2) Notwithstanding such repeal anything done or any action taken under the Ordinance so repealed, shall be deemed to have been done or taken under the corresponding provisions of this Act.
