Bare Act
The Himachal Pradesh Prohibition of Smoking and Non-smokers Health Protection Act, 1997
This Act establishes a comprehensive smoking ban across government buildings, public offices, courthouses, schools, hospitals, amusement centers, libraries, and public transportation vehicles throughout the entire state of Himachal Pradesh. The legislation prohibits smoking in these designated "no smoking" zones and also bans advertising cigarettes and other tobacco products that promote smoking. It authorizes government officials to enforce these restrictions, remove violators from premises where smoking occurs, and punish non-compliance with escalating fines—ranging from one hundred to five hundred rupees for in-zone violations and potentially much higher penalties for repeat offenses or advertising violations that may include additional fines or imprisonment. This law aims to protect non-smokers from secondhand smoke and discourage public smoking by making violations an offense in public spaces where people gather for work and use.
