After section 3 of the ptincipal Act. the following section shall be inselted, narhely:-- "(3A) Conditions for setting up trff'-campus centre.-- (l) The university shall bb allowed to set up only one off- cflmpus centre within the State of Haryana on fulfillment of the following cronditions. nalnely:- (a) it has completed five.years of establishment; (b) it has been accredited "A" grade by National Assessment and Accledited Council; it has nevel violated the conditions of Letter of Intent and the plovisions of the Act; it has obtained the apploval fi'om the University Grants Commission; and it has in its possession the land as described below:- (i) three acres of land by way of ownership or lease of thirty years. if the university intends to set up off'- campus cenh'e in a Municipal Corporation; (ii) four acres of land by way of ownership or lease of thirty years, if the university intends to set up off- campus centre in a Municipal Committee; (c) (d) (e) I.IARYANA GOVT. For sub-section (2) of section l0 of the principal Act. the following sub-sections shall be substituted. namely:- "(2) The university shall not open any study centre and examination centre in or out of the state of Haryana and shall not offer any programme through distance education mode' (3) The university shall not oft'er any programme through distance education mode from oft'-camPuS centre or off-shore campus established under clauses ( l0) or ( I I ) respectively of section 3 of the Act.". 6. For-sub-section (l) of section l7 of the principal Act, the following sub-section shall be substituted, namely. "(l) The Vice-Chancellor shall be appointed by the Chancellor as per the qualifications prescribed by the University Grants Commission, subject to the provisions contained in sub-section (7) and shall hold office for a term of three years: Provided that after expiry of the term of three years, the Vice- chancellor shall be eligible fbr re-appointment for another term of thtee years: Provided furlher-that the chancellor may furtherextend the term for another- three years if the vice-Chancellor has contributed significantly to r.aise the academic and research standards of the University: Provided further that a Vicc-Chanceltor $all continue to hold the office even after the expiry of his term lillttre new Vicrc{hancellor joins. In order to accommodate the unprecedented growth of students in higher education, and also to cross the target of 30% gross enrolment ratio (GER), we need to roughly double the number of institutions at all levels by 2020. The Government intervention would not be adequate to meet this benchmark in higher education. We need to enlist the participation of private sector in a major way. Haryana Private Universities Act, 2006 has been brought essentially to rope in private sector to supplement the initiative of Government in expanding the capacity in higher education and upscaling its standards. There is no private university in district Hisar, Bhiwani, Fatehabad, Sirsa and Jind to impart higher education in the area and therefore to achieve the objectives enshrined in the Act, proposal has been formulated for setting up of Om Sterling Global University, Hisar. (EXTRA.), MAY. 4, 2020 (VYSK. 14, 1942 SAKA) 77 PART-I HARYANA GOVERNMENT LAW AND LEGISLATIVE DEPARTMENT Notification The 4th May, 2020 No. Leg. 11/2020.— The following Act of the Legislature of the State of Haryana received the assent of the Governor of Haryana on the 16th March, 2020 and is hereby published for general information:- HARYANA ACT NO. 10 OF 2020 THE HARYANA PRIVATE UNIVERSITIES (AMENDMENT) ACT, 2020 A N ACT further to amend the Haryana Private Universities Act, 2006. Be it enacted by the Legislature of the State of Haryana in the Seventy-first Year of the Republic of India as follows:- 1. This Act may be called the Haryana Private Universities (Amendment) Act, 2020. Short title. 2. In section 6 of the Haryana Private Universities Act, 2006 (hereinafter called the principal Act),- (i) for the sign “.” existing at the end, the sign “:” shall be substituted; and (ii) the following provisos shall be added, namely:- “Provided that the Government may, on the request of the sponsoring body, change the name of the University on remittance of a fee of five lakh rupees by the sponsoring body: Provided further that the Government may, in view of the special status given by the Ministry of Human Resource Development, Government of India for declaring a private university as an Institution of Eminence Deemed to be University under the UGC (Institutions of Eminence Deemed to be Universities) Regulations, 2017, or any other special status given by the Ministry of Human Resource Development, Government of India or the Universities Grants Commission Act, 1956 (Central Act 3 of 1956), as the case may be, withdraw the status of such University under this Act by omitting its name in the Schedule. However, the provisions of this Act shall continue to apply to such University until the date of notification under section 3 of the Universities Grants Commission Act, 1956 (Central Act 3 of 1956).”. In the Schedule to the principal Act,- (i) serial number 1 and entries thereagainst shall be omitted; (ii) for serial number 9 and entries thereagainst, the following serial number and entries thereagainst shall be substituted, namely:- “9. The Sushant University District Gurugram”; (iii) after serial number 23 and entries thereagainst, the following serial number and entries thereagainst shall be added, namely:- “24.
