Liability of managing committee to punishment

Statutory text
- (1) If the president or the managing committee, as the case may be of any [educational institution]—
- (a) omits or fails without any reasonable excuse to carry out any order made under this Act; or
- (b) omits or fails to deliver any [educational institution] property to the Administrator or any officer authorised by him in writing, the president or the managing committee, as the case may be, shall be punished with imprisonment for a term which may extend to three months or with fine which may extend to one thousand rupees, or with both.
- (2) If the person committing an offence under this Act is a managing committee, every person, who at the time the offence was committed, was a member or office-bearer shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly : Provided that nothing contained in this sub-section shall render any such person liable to be prosecuted if he shows that the offence was committed without his knowledge or that he exercised all due diligence to prevent the commission of such offence.
