The Haryana Cattle Fairs Act, 1970
1. Short title and extent
(1) This Act may be called the Haryana Cattle Fairs Act, 1970. (2) It extends to the whole of the State of Haryana.
2. Definitions
In this Act, unless the context otherwise requires,— (a) "cattle" includes bulls, bullocks, cows, buffaloes, heifers, calves and camels; (b) "cattle fair" means a gathering of people for the purpose of trade or sale of cattle; (c) "Director" means the Director of Animal Husbandry, Haryana, or any other officer authorised by the Government to discharge the functions of the Director under this Act; (d) "Government" means the Government of the State of Haryana.
3. Cattle fairs to be held under licence
No person shall hold or organise a cattle fair in any place in the State of Haryana except under and in accordance with the conditions of a licence granted in the prescribed manner by the Director.
4. Power to cancel or suspend licence
The Director may, for reasons to be recorded in writing, cancel or suspend any licence granted under section 3, if the licensee contravenes any of the provisions of this Act or the rules framed thereunder.
5. Appeals
Any person aggrieved by an order of the Director under section 3 or section 4 may, within thirty days of the date of the order, prefer an appeal to the Government whose decision shall be final.
6. Power to exempt
The Government may, by notification, exempt any cattle fair from all or any of the provisions of this Act.
7. Cattle fair fund
There shall be established a Cattle Fair Fund in the prescribed manner which shall be utilised for the development of animal husbandry in the State.
8. Penalty for contravention
Any person who holds or organises a cattle fair in contravention of the provisions of this Act shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to Rs. 2,000 or with both.
9. Offences by companies
Where an offence under this Act has been committed by a company, every person who at the time the offence was committed was in charge of, and was responsible to the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence.
10. Cognizance of offences
No court shall take cognizance of any offence punishable under this Act except on a complaint made by the Director or an officer authorised by him in this behalf.
11. Protection of action taken in good faith
No suit, prosecution or other legal proceeding shall lie against the Government or any officer for anything which is in good faith done or intended to be done in pursuance of this Act or any rules made thereunder.
12. Power to make rules
(1) The Government may, by notification, make rules for carrying out the purposes of this Act. (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for the form of application for a licence, the fee for such licence, the conditions to be complied with by the licensee, and the management of the Cattle Fair Fund.
13. Repeal and saving
Any law corresponding to this Act in force in the State of Haryana immediately before the commencement of this Act is hereby repealed: Provided that anything done or any action taken under the law so repealed shall be deemed to have been done or taken under this Act.
