The Suits Valuation (Gujarat Extension and Amendment) Act, 1964

1. (1) This Act may be called the Suits Valuation (Gujarat Extension and Amendment) Act, 1964.
2. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

Section 1 of the Suits Valuation Act, 1887 (hereinafter referred to as "the principal Act") shall be renumbered as sub-section

1. (1) thereof and in that section-
2. (1) after sub-section (1), the following sub-section shall be inserted, namely:- "(2) This Act as in force in the Bombay area and the Kutch area of the State of Gujarat immediately before the commencement of the Suits Valuation (Gujarat Extension and Amendment) Act, 1964, shall also extend to the Saurashtra area of the State of Gujarat.";
3. (2) in the marginal note, for the word "Title" the words "Title and extent to State of Gujarat" shall be substituted.

In section 3 of the principal Act, in sub-section (I), for the words, figures, brackets and letter "the Court-fees Act, 1870, section 7, paragraphs v and vi, and paragraph x, clause (d)" the following shall be substituted, namely:- "clause

1. (d) of paragraph (iv), paragraphs (v),
   • (vi) and
2. (via) and clause
3. (d) of paragraph (xi), in section 6 of the Bombay Court-fees Act, 1959".

In section 4 of the principal Act, for the words and figures "the Court-fees Act, 1870, section 7, paragraph iv, or Schedule II, article 17," the following shall be substituted, namely:- "clause (c), (d), (e),

1. (f) or
2. (g) of paragraph
   • (iv) in section 6 of, Article 3, 4, 5 or 7 in Schedule I or clause
3. (a) of Article 23 in Schedule II, to the Bombay Court-fees Act, 1959."

Section 6 of the principal Act shall be deleted.

To section 7 of the principal Act, the following proviso shall be added, namely:— " Provided that, in the Saurashtra area of the State of Gujarat, it shall come into force on the date of the coming into force of the Suits Valuation (Gujarat Extension and Amendment) Act, 1964.".

In section 8 of the principal Act, for the words, figures, brackets and letter "the Court-fees Act, 1870, section 7, paragraphs v, vi and ix, and paragraph x, clause (d), court-fees are payable ad valorem under the Court-fees Act, 1870" the following shall be substituted, namely :- "clause

1. (d) of paragraph (iv), paragraphs (v), (vi),
2. (via) and
   • (x) and clause
3. (d) of paragraph
   • (xi) in section 6 of the Bombay Court-fees Act, 1959, court-fees are payable ad valorem under the Bombay Court-fees Act, 1959,".

In section 9 of the principal Act, for the words, figures, brackets and letter "the Court-fees Act, 1870, section 7, paragraphs v and vi, and paragraph x, clause (d)," the following shall be substituted, namely:- "clause

1. (d) of paragraph (iv), paragraphs (v),
   • (vi) and
2. (via) and clause
3. (d) of paragraph
   • (xi) in section 6 of the Bombay Court-fees Act, 1959.".

In section 11 of the principal Act,—

1. (1) in sub-section (1), for the words and figures "section 578 of the Code of Civil Procedure" the words and figures "section 99 of the Code of Civil Procedure, 1908" shall be substituted;
2. (2) in sub-section (4), for the words and figures "section 622 of the Code of civil Procedure" the words and figures "section 115 of the Code of Civil Procedure, 1908" shall be substituted;
3. (3) to sub-section (5), the following proviso shall be added, namely:— " Provided that, in the Saurashtra area of the State of Gujarat, it shall come into force on the date of the coming into force of the Suits Valuation (Gujarat Extension and Amendment) Act, 1964.".

The Suits Valuation Act, 1887, as adapted and applied to the Saurashtra area of the State of Gujarat by the State of Saurashtra (Application of Central and Bombay Acts) Ordinance, 1948, is hereby repealed: Provided that such repeal shall not affect—

1. (i) the previous operation of the Act so repealed or anything duly done or suffered thereunder; or
2. (ii) any right, privilege, obligation or liability acquired, accrued or incurred under the Act so repealed.
