The Minimum Wages (Gujarat Amendment) Act, 1961

Short title and extent.

1. (1) This Act may be called the Minimum Wages (Gujarat Amendment) Act, 1961.
2. (2) It extends to the whole of the State of Gujarat.

Amendment of section 2 of Act XI of 1948. In section 2 of the Minimum Wages Act, 1948, in its application to the State of Gujarat (hereinafter referred to as "the principal Act"), in clause (e),—

1. (a) for the words "the State Government" the words "the State Government" shall be substituted;
2. (b) for the words "any other authority" the words "any other authority" shall be substituted.

Amendment of section 3 of Act XI of 1948. 3. In section 3 of the Minimum Wages Act, 1948 (XI of 1948) (hereinafter referred to as "the principal Act"), in sub-section (1),—

1. (i) in clause (a), for the words "one year" the words "three years" shall be substituted;
2. (ii) in the proviso, for the words "one year" the words "three years" shall be substituted.

Amendment of section 5 of Act XI of 1948. 4. In section 5 of the principal Act, in sub-section (2),—

1. (a) for the words "one year" the words "three years" shall be substituted;
2. (b) for the words "six months" the words "two years" shall be substituted.

Amendment of section 9 of Act XI of 1948.—In section 9 of the Minimum Wages Act, 1948 (XI of 1948) (hereinafter referred to as "the principal Act"), for the words "composed of persons nominated by the appropriate Government representing in equal number employers and employees", the words "composed of such number of persons as the appropriate Government thinks fit, being persons nominated by that Government representing employers and employees in the scheduled employments in equal number" shall be substituted.

Amendment of section 10 of Act XI of 1948.—In section 10 of the principal Act, to sub-section (2), the following proviso shall be added, namely:— " Provided that in computing the period of five years, any revision of a minimum rate of wages made under clause

1. (b) of sub-section

1. (1) of section 3 shall be excluded."

Amendment of section 12 of Act XI of 1948.—In section 12 of the Minimum Wages Act, 1948, in its application to the State of Gujarat (hereinafter referred to as "the principal Act"), in sub-section (1), for the words "the minimum rate of wages fixed by the notification and pay to every employee engaged in a scheduled employment or before the expiry of the seventh day" the words "the minimum rate of wages fixed by the notification and pay to every employee engaged in a scheduled employment on or before the expiry of the seventh day" shall be substituted.

Amendment of section 13 of Act XI of 1948.—In section 13 of the principal Act, in sub-section (1), for clause (b), the following shall be substituted, namely:—

1. (b) provide for a day of rest in every period of seven days which shall be allowed to all employees or to any specified class of employees and for the payment of remuneration in respect of such days of rest at a rate not less than the overtime rate; Provided that the provisions of clause
2. (a) and
3. (c) shall not apply to the employees in any scheduled employment in respect of which any order under clause
4. (k) of sub-section

1. (2) of section 30 has been made.

Amendment of section 14 of Act XI of 1948.—In section 14 of the principal Act, in sub-section (1), for the word and figures "section 13", the words and figures "section 13 or section 13A" shall be substituted.

Amendment of section 18 of Act XI of 1948.—In section 18 of the principal Act, for the words "Every employer shall maintain such registers and records", the words "Every employer shall maintain and keep open to inspection in such manner as may be prescribed registers and records" shall be substituted.

Amendment of section 19 of Act XI of 1948.—In section 19 of the principal Act, in sub-section (2), for the words "any premises or place", the words "any premises or place where employees are employed or work is given out to outworkers" shall be substituted.

Amendment of section 21 of Act XI of 1948.—In section 21 of the principal Act, in sub-section (1), for the words "six months" the words "one year" shall be substituted.

Amendment of section 22 of Act XI of 1948.—In section 22 of the principal Act, for the words "three months" the words "six months" shall be substituted.

Insertion of new section 22A in Act XI of 1948.—After section 22 of the principal Act, the following section shall be inserted, namely:— "22A. General provision for punishment of other offences.—Any employer who contravenes any provision of this Act or of any rule or order made thereunder shall, if no other penalty is provided for such contravention by this Act, be punishable with fine which may extend to five hundred rupees."

Amendment of section 22B of Act XI of 1948.— In section 22B of the principal Act, in sub-section (1), for the word “Authority” wherever it occurs, the words “Authority or any officer authorised in this behalf by the State Government” shall be substituted.

Amendment of section 26 of Act XI of 1948.— In section 26 of the principal Act, in sub-section (2), for the words “The State Government may,” the words “The State Government may, by notification in the Official Gazette,” shall be substituted.

Amendment of section 27 of Act XI of 1948.—In section 27 of the principal Act, for the words "appropriate Government may, by notification in the Official Gazette, add to either Part I or Part II of the Schedule" the words "State Government may, by notification in the Official Gazette, add to either Part I or Part II of the Schedule" shall be substituted.

Amendment of section 30 of Act XI of 1948.—In section 30 of the Minimum Wages Act, 1948, in its application to the Bombay area of the State of Gujarat (hereinafter referred to as "the principal Act"),—

1. (a) in clause (a), for the words "the Official Gazette" the words "the Gujarat Government Gazette" shall be substituted;
2. (b) in clause (b), for the words "the Official Gazette" the words "the Gujarat Government Gazette" shall be substituted;
3. (c) in clause (c), for the words "the Official Gazette" the words "the Gujarat Government Gazette" shall be substituted;
4. (d) in clause (d), for the words "the Official Gazette" the words "the Gujarat Government Gazette" shall be substituted.
