Penalty for second and subsequent offences

"49AA. Penalty for second and subsequent offences.

If any person convicted of an offence punishable under section 39, 39A, 39AA or 44 is again convicted of an offence under any of the aforesaid provisions, he shall be punishable for the second and for every subsequent offence with imprisonment for a term which shall not be less than three months but which may extend to five years and with fine which shall not be less than fifty thousand rupees."
