The Bombay Prevention of Gambling (Gujarat Amendment) Act, 1964
1. Short title
This Act may be called the Bombay Prevention of Gambling (Gujarat Amendment) Act, 1964.

2. Short title, extent and commencement This Act may be called the Bombay Prevention of Gambling (Gujarat Amendment) Act, 2003.
Amendment of section 6 of Bom. IV of 1887
- (1) Section 6. of the Bombay Prevention of Gambling Act. 1887 (hereinafter referred to as "the principal Act") shall be re-numbered as sub-section
- (1) of that section, and in that sub-section -
- (a) in clause (i), for the portion beginning with the words "a District Superintendent of Police" and ending with the words "in this behalf" the words "a District. Additional, Assistant, or Deputy Superintendent of Police" shall be substituted:
- (b) in the proviso, after the words "the District" the words "or Additional" shall be inserted,
- (2) After sub-section
- (1) as so re-numbered, the following sub-section shall be added, namely : - "(2) Notwithstanding anything contained in any law for the time being in force, no search made under this section shall be deemed to be illegal by reason only of the fact that the witnesses (if any) of the search were not inhabitants of the locality in which the house, room or place searched is situate.".
3. Deletion of section 11 of Bom. IV of 1887
Section 11 of the principal Act shall be deleted.
1. Short title This Act may be called the Bombay Prevention of Gambling (Gujarat Amendment) Act, 2003.
2. Amendment of section 3 of Bom. IV of 1887 In the Bombay Prevention of Gambling Act, 1887, in section 6, in subsection (I), before clause (i), the following clauses shall be inserted, namely:-
"(ia) in any area of the State, not below the rank of Sub-Inspector of Police, authored in each case by special warrant issued by the Additional Director General of Police (Law and Order) or whoever is holding that post in any rank or Additional Director General of Police C.I.D. (Crime); and
(ib) in any area of police range not below the rank of Sub-Inspector of Police, authoesed in each case by special warrant issued by the Special Inspector General of Police or Deputy Inspector General of Police appointed for the respective police range; and "
3. Insertion of new section 3A in Bom. IV of 1887 " 3A
- (1) Whoever prints or publishes in any manner whatsoever any digits or figures or combination of digits or figures rdatifig to Worli MQth or any other form of gaming under the heading " Shdh Rnshi " or by adopting any other form or device, or dissenlinates or attempts to dissenlinatc or abets in the dissenlination of information rzhting to such digits or figurea or oombination of digits or figures shall be plmishabk with impriso~mcnt which niay extend to six months and with he which may extend to one thousand rupees.
- (2) Where any person is accused of an offence under sub-s.ction (I), any digits or figures or c~lribination of digits or figures in rcspect of 1~11ich the offence is alleged to have been committed shall be presumed to relate to IVorli ltiutka gaming or solue other form of gaming unleas the coutrary is proved by the accwd.".
4. Insertion of section 6A in Bom. IV of 1887
"6A. Where -
- (i) in any area for which a Cornlzissimcr of Police has been appointed,
a police ,officer not below the rank of a D~puty Comniasioner of Pol~ce, and
- (ii) elsewhere, s police officer not below the rank of a Deputy Superin- tendent of Police, is of tho",pinion that any rcgistcr, record or writing of any kind mhatsoevcr which contains digits or figures or combination of digits or &urea relates to Worli Mdka gamin$ or some othcr form of gaming, he shall be elltitled to seize the same, and such register, rccord or writing shall be prcsumcd to be an instrument of glrning u~llcss it is shown by the pcrson from whom it is seized that it is a r gister, rccord or writing of any transaction in connection with a Ia\Pful trade, industry, busi~lew, profession or vocatio~ or of any lawful personal trallsaction of any person or it is otherwise not an instrument of gaming.".
5. Amendment of section 12 of Bom. IV of 1887

1. Short title This Act may be called the Bombay Prevention of Gambling (Gujarat Amendment) Act, 1964.
2. Amendment of section 6 of Bom. IV of 1887 -1 2. In the Bombay Prevention of Gambling Act, 1887, in section 6, in subsection (I), before clause (i), the following clauses shall be inserted, namely:- (ia) in any area of the State, not below the rank of Sub-Inspector of Police, authorised in each case by special warrant issued by the Additional Director General of Police (Law and Order) or whoever is holding that post in any rank or Additional Director General of Police C.I.D.
